Not a very good comparison but lets say Redten,s unlimited disappeared on the last week of a 3 year contract do you think the court would disregard the 155 weeks of service delivered and order payment of the full amount the courts try to make recompense but only for your loss not to make a profit.
I'm not for one moment saying Redten ever delivered the full service to every one but that you would only get back the value of the missing part as decided by the court not the full contract value
Courts never black and white --your entitlement is full recompense where the contract is broken or repudiated especially in first half of contract.
Courts then take into account reasonable behaviour of both parties and whether one party could have had prior notice or knowledge of the contract being unable to be fulfilled. Plus for every rule there is an exception.
For example if your claim is over £200 in total but less than 1500 the maximum expenses that can be claimed by the defender clode or pursuer is £150 if they win; but the pursuer can actually claim much more if the defender has acted unreasonably in responding to the claim from day 1 or acts in bad faith in defending etc.
Remember all the varied reasons given for not delivering the contract? by both companies. Remember the "its nothing to do with me gov " responses from clode whilst " working in close contact with the elusive redten "and njp
That only redten can end the contract and now its only clode who can end the contract.
That no-one would respond to recorded delivered letters and even OFCOM and TSO could not get hold of them?
Do you honestly believe a court would think that reasonable behaviour

Never tried to as it would no doubt be available on mag cd covers and of no interest to me.
I did however get the Vista upgrade, all the hardware asked for and a 6 Meg reliable service with unlimited bandwidth until the Walled garden, from joining in November 2006
Same here, except joined in Feb 2007. Got Vista upgrade but never used it as not sure PC would run properly after putting it on.0 -
i payed them 4 months at 24.99 a month got 4 months broadband + computer never got laptop but got my contract terminated by clode after i was cut off by redten on 10 mar and not connected to njp no 1 asked for the computer back but i must be out over £200 on phone calls was hardly worth it i am now connected to bt at 24.99 a month and im getting up to 2.5 mb download witch is good for where i live when i was on bt wholesale through redten i was only getting 400kb i think the bt wholesale setup is a half baked service from bt0

Ye thats what i think also, as the service, ar least for me, was ok till march. I understand that we can and will claim back from March onwards, but not before that.0 -

Please note we have a collected pot of bandwidth and that is share amongst our Customers. Hence if some Customer abuse the fair usage policy that we shall have no option but to restrict the download to a maximum of 10Gb per month for those Customers.

thats changed from original --original in terms and original facts and was similar to other fair usage policies of notice and warnings if excessive use and only during peak hours etc etc. Full detail is on a previous post and on the terms of deadten site.
