I'd be quite happy with just the remaining contract cancelled - free of penalties. If FCI is correct, then that's quite a good option for Clode as well.
We will very shortly know as May Day is D day or C Day really. Much as I have loved the company and very funny comments and quotes on this forum I am not going to spend another month being driven round the twist by a company which cannot honour its contracts and tries everything to avoid its liabilities.
I have always honoured my side of the bargain and am now seeking the appropriate and legal compensation for their failure to do likewise.
I have made perfectly reasonable proposals to them to clear my account.
The court will decide who owes what to whom if Clode cannot.

Just checked my old Tiscali Mailbox and found email from Clode dated 00.00 28/4/08 .
Current balance £402.69 with 31 payments of £12.99 to go. Settlement figure £30.69 - very reasonable
I kept my letters to Clode short and brief - my complaints were the lack of "unlimited" and the Download speed 500Kps (prevously 1Mps on Pipex, the limit of the package while line is capable of around 2Mbs) and gave 28 days notice to sort problems.
I think people should remember that Redten was Clodes' customer. They would have had to given Redten notice to sort their affairs out - probably 28 days - hence all the meetings with Redten etc. They couldn't do or say much until the notice had expired hence the offers now. One option I suggested was to pay for my broadband from another supplier which is basically what they have offered.
There are lots of offers out there for unlimited broadband and I'm sure most people can find a package that suits their circumstances sky or Virgin if you watch satillite TV, some with "free phone line rental" 02 customers can get a £5 discount. With £12 a month help most of you could find a bundled package where you would be no worse off and hopefully reliable service.
We should also remember that the £500 computer in 2006 was down to £300 a year later hence the lower price a year later - LCD s etc falling in price. The total package cost was based on cost of supplying PC and 36 months broadband even if the PC was invoiced as free.
I think Clodes next move will be an offer aimed more at the original customers which will probably be same formula but halving the settlement fee - they won't want a load of 2nd hand obsolete computers - better check your mail box on 3rdMay!
Next I think they will review the situation and deal with any "special cases"
If they get their sums right most will have accepted, problably several thousand customers. If there are only a few hundred left then they will probably be deemed "unreasonable" in their demands making a successful court appearance unlikely. Of course there might be only a handful of people left who won't settle - in which case the chances are they will just "write them off"
Hope we all get offers that suit!0 -

I am pleased you have had a reasonable settlement figure, and am happy for you, however the scattergun approach is blatently unreasonable and unfair on the longer serving customers. My current balance is £399.80 with 20 payments of £19.99 to go. and they have given me a settlement figure of £159. You have ended up with a 5 month old computer for the grand total of £95, plus 5 months of broadband supply, and your computer was part of a broadband/computer package, on the other hand I have already paid £320 making my total cost £479 for my "FREE" computer, and as you say an 18 month old computer is virtually obsolete, the one supplied wasn't far off obsolete when it was new!
Please don't get me wrong I am happy for those of you that have had a decent offer, and I would also have accepted had my offer been the same, but please don't say we should all be happy with our offers, and that we can get good deals.
I for one live out in the sticks, and the LLU services won't be here for months yet, so the likes of O2 and Be are not available, My quote from Talk Talk was for £24, BT was the same, this was why Myself and others like me chose RT in the first place.
Also please don't take this mail as a personal attack on yourself, I am just trying to put things into perspective as to why some of us older customers are not happy with the offer made.
Personally I have refused my offer and put in a counter offer which I am awaiting a reply to.
Good luck to yourself and others who feel they can deal I hope to join your ranks soon.

Im still waiting for an offer but have worked out on the basis of everyone else's mine would be £372
They were still saying the pc was worth £500 when i signed up aug 07, and was the same spec as the 2006 offer and obsolete in general, never worked properly from day one. and the lcd supplied was a cheaper model than the LG originally offered.
as for the whole clode probably having to give redten 28days notice to sort their affairs out bit. I think that is fair enough for those that were happy to stay with redten if they resume normal service, but not for the customers that just want out full stop. Clode know redten are in breach and could have cancelled under the terms of our agreements but they chose to drag it on. My original complaint to Clode was more than 7 weeks ago and to date I have not had a single personal response. I have continued to pay and have fulfilled my contractual obligations. Neither Redten nor Clode have. They have acted with utter contempt for us and personally a deal where i have to pay anything so that they can recoup some of their money from Redten is not acceptable.0 -

I have not had an offer but based on the blanket formula come in at £402 they accept debit card only ie. cash out of the bank. Where do they expect people to get that sort of cash. How about letting people pay of the offers for the remainder of the contract monthly.... interest free??0 -

Fair point put it to them, they can only say no, however don't lose sight of the fact that your contract has been breached, and you should be released without penalty, even if that means them taking back the computer, which would need legal advice on whether they can do that, my personal knowledge on that is limited which is why I am talking to a solicitor, check your home insurance policy for legal cover, failing that CAB or trade union if you belong one. Good Luck anyway

Ta!
I'd be very grateful for the same info,I'm in Dundee area and am looking to start court proceedings ASAP:beer:0 -
I got my offer off Clode today, £30.64, not sure why I am on £13.00 a month instead of £12.99 but hey ho. I am happy to take this as I only signed up in November 2007. Does anyone know if they respond to a respond to their email??
Basically I am accepting the offer but seen as I never got my £79.99 printer I paid for I have accepted and they owe me £49.35 to settle and cancel the account.
Be interesting to see what their response is!!!??0 -
