Just heard from my insurance co legal expense solicitor after looking at the info I sent and probably this forum as I referred him to it

He,s advice is that in all probability I would win this breech of contract in court, however as the basic amount involved (as I quoted about £400) was less than the anticipated expense and in such cases he would recommend to the insurance co involved to pay me the amount I would be suing Redten/Clode for .

Don, t know if the insurance will wear that but it is their legal expense solicitor recommending it.

Problem is if I get that cash do I pay off Clode or just stop paying them and use the cash to defend their claim if they take me to court

But till I get my MAC nothing happens
    Who cares ??
  • Just spoke to clode and spoke to some guy. No manager is in for me to speak with again.

So I read out the letter from Trading standards mentioning taking them to court. He said if thats what you have to do, then do it.

    I'm left with no alternative.

    Thanks Clode.
  • Just found out my court costs will be £65 well worth it. Total Amount £603.58

I'll deliver them by hand on monday AM to Winchester Combines Court with my Cheque of £65 made to HMCS.

They have had well over a month to sort this mess out.

    They now take the *ISS.

And if you think I wont do it! Your Wrong Clode.

We know you read the forums.

Hi all, Whilst I agree with what dafftbint is doing, I'm waiting for tomorrow when my DD payment should have gone out - but no longer exists! and I'll wait for clode to send me the no payments letters, add charges etc! Then they can issue court proceedings against me and let them explain to the judge what has been going on with redten, clode etc!

If we all stopped payments to clode, then they would have to take note or setup another dept to take us all to court!!!

    clode - I'm waiting...

    andyg

I rang Clode this morning, spoke to Martin. I asked as to where our letter was. No letter will be being sent as the situation is still unclear, but we will be getting something from Redten direct!

I challenged the various points I had made in my several letters of complaint to Clode and he eventually passed me over to Nicola Dobson. She said that she had come back into the office today hopeful that something had been resolved, but sadly not.

The upshot is that there will be a letter coming out from Redten, but Nicola couldn't say when that would be.

When I pressed the 'breach of contract' issue from both Redten and Clode she denied that Clode are in breach.

    'But you are jointly liable',
'No we are not! The contract for the product/service is between you and Redten. You have got your broadband service back haven't you?'
'I have a broadband connection, yes, but not the service I signed up to'

I mentioned that we were not given notice of the change of service - 'Redten have assured us that they gave all their customers at least 14 days notice of the disruption prior to the 10th March'
I stated that this is one of the main areas of complaint i.e. Redten have not informed any of their customers or kept them informed during this debacle

'What if I stop my DD?'
'Then you will be in breach of the contract with us (Clode)'

Clode are obviously in denial and stalling for time once again. I was ringing from my mobile and the line was poor, she took my landline number and 'promised' to ring me if and when there is any news or developments.

By the way Nicola did confirm that Baber had resigned as MD from Redten

Well reported - they're still trying the ignorance is our defence tactic. They know full well that our current service isn't what we ordered. They also know full well that we signed up to three years unlimited broadband, which came with a free PC. I couldn't have put it any clearer to them in my letters - perhaps they haven't bothered reading them! That would be a surprise - not!!!!

    Hi,

Forgot to say earlier - when I was speaking to the man at Ofcom earlier, he said that their advice for Redten customers was to get independent legal advice, and to send them final written warnings - or better still, to get a solicitor to do it, which would "add weight". They seem to be oblivious to the fact that this would cost us more money, and does make me wonder what they're for... will definitely be writing to my MP next week about this, regardless of the outcome of all this.

Also, just to remind people about the ISP Review site:
You can enter a review of Redten here:

And they tally complaints about ISPs here:

Guess who just emailed the http://www.deadten.com site

    =======================================

I would just like to inform you that I have officially resigned as Managing Director of Redten as of the 18th of April 2008.
I would like to kindly ask of you to remove my details from your site as it is no longer relavant and that I have handed in my company phone of

People can still attempt to contact me but it will be to no avail as I will not have any answers for them as well as I am not legally obliged to comment on the
    running of the business.
So please encourage your guests to refrain from sending me mail or attempting to call my personal line.

Just like to take a moment to congratulate Martin Lewis on his victory at court today about bank overdraft charges.
Hopefully he can do something for us soon, i know he is a busy man but he knows that what is going on here is wrong.
