This is my reply to Clode letter recived this friday: Do you think i am being to soft?
Following from your recent reply to my complaint, your letter dated 07 April 2008 regrettably failed to address the problems I have [FONT="]mentioned in my original letter of complaint. Your letter which is written for mass reply ridiculously ends up stating that the matter is now resolved, considering that this is my complaint it should end resolved when I am happy with the result. [/FONT]
[FONT="]As I am receiving a limited broadband service instead of the unlimited one, what I signed up for and still paying for, this matter is not resolved. [/FONT]
[FONT="]As far as I am concerned Redten has breached the contract numerous times, mentioned in my original letter, and you are jointly responsible for it.[/FONT]
[FONT="]Due to the following:[/FONT]
1-Failure to give me notice of the contract change and its details and allowing me the opportunity to reject it.
2-Failure to notify me of my consumer protection rights at the time of the change.
[FONT="][FONT="]3-[/FONT][/FONT][FONT="]Providing a lesser and degraded service. [/FONT]
[FONT="][FONT="]4-[/FONT][/FONT][FONT="]Instituting a cap and blockage on my broadband connection and access when my contract was for unlimited and uncapped service. [/FONT]
[FONT="]5-Failing to provide me with a service for 10 days in march following their application of a cap on the service. [/FONT]
[FONT="]6-Failing to provide any information on any of Redten proposed changes yet giving public statements to the press which outline a detrimental service. [/FONT]
[FONT="][FONT="]7-[/FONT][/FONT][FONT="]Failing to provide reasonable duty and care in the provision of a service.[/FONT]
[FONT="]I am giving you 10 working days notice to terminate my contract without any penalty, arrange for pickup of the laptop provided as part of the agreement and provide me with a migration code MAC.[/FONT][FONT="] Send written confirmation to myself of the ending of this agreement without any financial penalty, inconvenience & adverse credit rating effect to myself. Should this not be forthcoming, I will be left with no option but to escalate the matter through the proper channels.[/FONT]

And I still dont understand how RedTen can operate without an ADR. Surely this should be enough to get them shutdown or nulify the contract since it is a legal requirement that they subscribe to this.
As all the other laws and such that they have broken!! We are living in a country that just rewards people who are basically theives. Taking my money and giving me no value for that money in return.Ron.

It's bad that there isn't a set body who can investigate on our behalf and then have the power to force Clode/Redten to either fulfil our agreements or release us scot free. Ultimately, I expect it will come down to using the court system - so much for consumer protection.Beware the character seeking personal gain masquerading as a moral crusader.

Yes but we must continue to fight. We are all in the same boat. We want out of the contract. Keep putting pressure on clode.
I sent a a letter saying I dont agree the complaints procedure was followed and please re-read my letter dated 1/4/08 and address my concerns as they decided to ignore everything I wrote.
I have re-opened the file by doing so. If they fail to act on that I will have no choice to fill out my FOS forms.
I expect they are so overloaded that they cant handle the volume of complaints they get about redten.
I bet this is the first time they have had the CCA mentioned in a letter about a supplier. I expect they are concerned about the massive threats of legal action.
They have only themselfs to blame.
Redten cant make a profit! Its so clear to see that the margin is tight or non-existent. But they intended to use us to re-sell other products and services as a source of revenue. Why finance a risky venture?

I sent another of to clode and redten on saturday also sent them email copies. I have also sent copy to ofcom.

Dont forget we should be able to charge for sending a repeat letter. I am stil waiting on my local CAB to get back to me on this but it looks promising at this time. just have to find out how much to charge them.Ron.
