You forgot to mention Common Law
Personally, I would have referred to clause 3.7 as the Jurisdiction Clause.
However, I WASN'T around to try and score points for legal jargon, I was trying to help fellow people in plain English. For those not familiar, tort is the name given to a body of law that deals with civil wrongs that do NOT arise out of contract.

I was merely pointing out that you do not actually have to go to any other agency or raise any additional actions as all of the other civil rights that have been breached such as the communications act ' misrepresentation / are in themselves substantive breaches of the contract by virtue of clause 3.7.
Indeed the latest edit from Clode and posted here is a substantive breach of 3.7 as it is a misrepresentation of the original breach of contract with BT and the provision of lesser service as a result.
Merely trying to reduce the actions to the minimum necessary but still ensure that reference is inclusive of any evidence/claim one wishes to put forward in support of the substantive breach.

So from the RBB numbers it looks like there are approx 5000 to 10000 of us Redten customers that's assuming the RBB numbers are sequential.
Nov '06 to Nov '07 100014** to 100099** the vast majority being in the first 3 months.
Well :money: we are a formidable group of people with alot of buying power. I know you might consider us too be cuckoos taking over your nest, but in reality we are consumers who know and use your site, and respect and adopt alot of your suggestions.
Help us sort this one, and you will have 5000 to 10000 happy bunnies singing your praise and continuing too use your services.

I have noticed a lot of new online ID that have joined this forum. Is there any way of making a list so we know how many users are on the forum. Maybe the list could be put on the DEADTEN site. Any one think this is possible. I feel sometimes like it is the same people and then the whole world is here. Just one bit less confusion for me if anything.

Fair-Usage Policy
Our Fair-Usage policy is designed to ensure your service remains
fast and reliable at all times. A very small number of customers
use high bandwidth applications, such as file-sharing software
(also known as “peer to peer” or P2P) or other applications,
which constantly send and receive many different types of files,
usually quite large in size.
This type of activity uses a lot of bandwidth and can
significantly reduce the speed at which other customers can
access the internet during peak hours. Approximately 1% of
customers use more than 30% of the available bandwidth during
peak hours. We don't believe this is fair to the vast majority of
our customers.
Please be aware we may give priority to light users over heavy
users. Our Fair-Usage policy automatically identifies the very
small number of extremely heavy users and manages their
bandwidth, to protect the service for all our other customers.
Outside peak hours, the use of the internet by these heavy users
is not affected.
We think this is a fair approach. It protects the quality of
service for the majority of our customers when they most use the
service.
Am I likely to be affected by the Fair-Usage Policy?
If you don't use Peer-to-Peer or file-sharing software it is
unlikely you will ever be affected by this Fair-Usage Policy.
If you are affected, we will contact you by email to let you know
that your usage is excessive and is affecting other customers, or
you may be disconected but an option will be offered to purchase
more bandwith if you wish to constantly send and download large
files.
Please note: the bandwith is monitored, plase do not abuse this
fair usage policy.
During peak hours, customers affected by the Fair-Usage policy
will share bandwidth with each other and will be separated from
other customers.
The speed affected customers experience when downloading will
therefore depend on what these customers are doing. If they are
all web-browsing and reading emails, they will experience normal
broadband speed. If, on the other hand, they are using
Peer-to-Peer or file-sharing software they will experience slow
broadband speed.

Just a note on my Clode contract as a 70 year old on basic pension I may just stop paying and when sued offer to pay £1 per week which would probably be accepted by the County Court LOL

Seems like if you do actually manage to get through then the process is that they email NJP asking for the restriction to be removed.
When I spoke to NJP they said this was not possible. and that they would not remove any restriction.0
