I'm now on a BT UNLIMITED SERVICE.

start some heavy download sessions and see what 'unlimited' means to BT, they got very upset with me.
    ;)

All stautory and tort rights are enshrined in clause 3.7 of the express terms of the contract. They are called further and better rights and entitlements.

    F.

You forgot to mention Common Law ;)

Personally, I would have referred to clause 3.7 as the Jurisdiction Clause.

However, I WASN'T around to try and score points for legal jargon, I was trying to help fellow people in plain English. For those not familiar, tort is the name given to a body of law that deals with civil wrongs that do NOT arise out of contract.

Good luck in your fight everyone. :hello:

ok just spoke to Clode, they are giving blanket answers now, which is to cancel the contract Speak to Redten,
any complaint they will not anwser on the phone, you have to email/write in and they will answer them, they will also not put you through to supervisors or managers. just brick walling us all
  • They are wanting us to not go to the FOS/Small claims court.

They forget they are liable as well. They forget they have to use the complaints procedure they set out. They have even failed to do this.

They have obligations under their Credit Licence! They even forget that.

I'm about to speak with the FOS now. I do not agree that they have followed the complaints procedure as set out in the link below. The email seems to be closure on their behalf. I do not agree that the matter is settled and the file should remain open.

Redten keeps changing the story. Now its about illegal downloads. Really!
I expect they didn't pay BT the Bill. The only people who would touch them are NJP. They now seem to use illegal downloads as an excuse for the 2 then 5 and now 15GB cap.

They are buying time. Which you must ignore and follow the email with a email or recorded letter or both. WE must keep on at them. Show the FOS we have done all that we can to resolve the matter.

As they sent a email, you can challenge the contents by email. Just keep a copy of it.

Clode wont do anything. Can only cancel on the instruction of Redten. The guy i spoke to was very apologetic and said they are having as many problems as we are, getting hold of them etc.

Basically if Redten give Clode the instruction then they will cancel but they cant do that without Redtens say so. I argued how do I get that if they wont respond to my emails, calls, letters etc.

Circular argument that got nowhere. Back on to Redten now.

Just spoke to Paul at NJP. Despite letter from Clode, they still need a MAC code from Redten to take me on.
I was one of those who took the BT Mac. It was then rejected and I am stuck in limbo!
Paul said to call Redten. I am on hold again, 15 mins and counting.
Will have to get back to Clode and say that I have not been reconnected.
I just want the connection I paid for. 3 years upfront!!!
