    You will note that the NJP supplied broadband service is currently limited to a maximum 15GB download limit per month which differs from the previously supplied ‘unlimited’ facility provided under the BT service.

    We understand from Redten that this is a temporary measure introduced whilst they evaluate the recent industry concerns around illegal downloads of various forms of copyrighted media.

    Do they honestly think anyone will believe that

    This is an excuse cause they cannot afford any higher.

    They dont even adhere to the laws that are in force never mind ones which might come in.

    In any case how does restricting anyone stop copy right violations?

    That's as ludicrous an excuse if I have ever heard one.

    I have had my contract broken and terminated and under section 12.12 of those express terms of contract I am entitled to have my contract with Clode ended and given a mac to go elsewhere.

    End of story

    I have not even received that load of Bull and I am impressed at your self control with the language, I on the other hand have been known to swear and my response leaving out the swear words is nothing.
    Like you say this is smoke and mirrors, lets muddy the water and see where we get to, nothing has changed in law, we agreed to a service and they have not provided that service, give me my MAC and I for one will see them in court. :mad::mad::mad:

    Come on, you promised your team would look into this fiasco on our behalf. That was over a week ago - surely you must have been able to contact Redten / Clode / NJP with our complaints and get an answer out of them, or are you still waiting for a response also??

    We just want want we signed up for!!! :confused:

    No email here from Clode and I would be straight on the phone if I received that pile of crap from them. Sorry to be harsh, but that's the way I feel.

    Also, after being promised, PROMISED a call back from Clode yesterday I am still waiting. Another call will go in today, ANOTHER complaint. When will they listen?

    Oh, and my Redten Number is 10002041. I dont care if they know who I am - I WANT them to know who I am.

    Great post in general Mac, but be careful with "loose words" ;) as this is not strictly true.

    I'm a bit poorly today, so wont go into detail ("thank goodness" I hear you cry) but it is possible to break a part of a contract without giving the other party an automatic right to rescind. It has to be a SERIOUS/FUNDAMENTAL breach.

    There is no doubt in my mind that breach of Clause 12.12 of the Redten contract - and by Statute of section 9.3 of the Communications Act 2003 - constitutes a serious/fundamental breach.

    We did not get the required written notice - as required by this Clause and by Statute - which should have given us the opportunity to terminate our Contracts before the switch/modification which was likely to be of material detriment. (ie unlimited to capped)

    Because we wuz robbed of the opportunity to terminate our Contracts before the switch/modification, it follows that this is serious enough to allow us to end our contracts as a result.

    I got my BT hub in the post today. I makes the redten modem look cheap.

    For the early customers of RD, I'm right in saying the connection charge included the cost of the modem?
  • By the way, guys...did anyone get 14 days written notification from Clode or Redten about the change to the service down to 15Gbs? If not, they've broken the contract again. I'm fairly certain someone posted part of the contract which stated that changes can take place as long as they give you 14 days written notice.

    That's Clause 12.12 of the Redten contract to which I refer to in my post above.

    But in any case as I have mentioned previously, Redten cannot write terms and conditions in their contracts which afford less protection in conflict with Statute:

    Section 9.3 of the Communications Act 2003 states:
    9.3 Where the Communications Provider intends to modify a condition in a
    contract with a Consumer which is likely to be of material detriment to
    the Consumer, the Communications Provider shall:
    (a) provide the Consumer with at least one months notice of its
    intention detailing the proposed modification; and
    (b) inform the Consumer of the ability to terminate the contract
    without penalty if the proposed modification is not acceptable to
    the Consumer.


    So we should have got ONE MONTH'S NOTICE - despite Redten saying 14 days.
