That's Clause 12.12 of the Redten contract to which I refer to in my post above.

But in any case as I have mentioned previously, Redten cannot write terms and conditions in their contracts which afford less protection in conflict with Statute:

Section 9.3 of the Communications Act 2003 states:
9.3 Where the Communications Provider intends to modify a condition in a
contract with a Consumer which is likely to be of material detriment to
the Consumer, the Communications Provider shall:
    (a) provide the Consumer with at least one months notice of its
intention detailing the proposed modification; and
    (b) inform the Consumer of the ability to terminate the contract
without penalty if the proposed modification is not acceptable to
    the Consumer.

So we should have got ONE MONTH'S NOTICE - despite Redten saying 14 days.

All stautory and tort rights are enshrined in clause 3.7 of the express terms of the contract. They are called further and better rights and entitlements.

This piracy thing is a load of crap. Let's get the facts straight. The government has threatened to look at passing legislation to force ISPs to reduce piracy - this is where the 3 strike suggestion has gained popularity. The record industry would be telling the ISP that someone is infringing, the ISP warns the user, and at the 3rd time, can disconnect them.
It's a suggestion, TalkTalk has been the most vocal against it, but as of NOW, ISPs have nothing to do with what a user does. As has been said repeatedly here, the 15gb limit is either cost or bandwidth saving, or 'adjustment'. And if it's 'temporary' it can last until at least the end of the year as anything to do with legislation will take ages.
Once thing for certain is that it is NOT the unlimited service being paid for, and every month of this 'temporary' service is a month not to be paid for!

  • I have not received any letters or emails from clode ( or redten for that matter or NJP services. )

I have just sent the final polite letter to Clode inviting them to make me a settlement offer in accord with the terms of contract, full refund of all monies paid to them and redten; and/or alternatively cancellation of the credit contract with cloderetailfinance.

Both entitlements are within the expressed terms.

I have also advised them that if they fail to respond, I shall seek an FSO and/or CCJ settlement.

They have 14 days to respond.

And when Clode cancelled my account all i received was an email saying cancelled i ask for it to be sent by letter they said it was not company policy to send letters saying accounts were cancelled.
  • I did the same by Email FCI

    I used the words WHITEWASH.

I feel for you all now with regards to privacy and the Clode letter that suggests they monitor what you up/download. My service for Broadband is with BT now PHEW!

FCI the FOS will not do anything for the first 8 weeks! You got to use that time to try and sort it out.

Still not opened my phone bill. I'm to frightened:eek:

got Clode's email over night and decided I'd follow there instructions and called RedTen to increase my 15Gb (ok you can stop laughing now) got through and was told I'd get a call back in 20 minutes. after 30 mins called back and was promised again that I would get a call back in 10 mins, after another 30 mins no call, so rang again, this time different person, got stuck on hold for 10 mins then cut off.
    Clode can't say I didn't try.
