Just to clarify dave_allen77:
We have a contract with Redten AND we have a contract with Clode.
But if Redten breach the contract we have with them, we have further protection afforded by the contract we have with Clode.
If you look at your Clode contract above the box in which you signed and dated - it's there in black and white:
The Consumer Credit Act 1974...gives you a number of rights:
It
2) If You received unsatisfactory goods or services paid for under this agreement You may have a right to sue the supplier; us or both.
3) If the contract is not fulfilled, perhaps because the supplier has gone out of business, You may still be able to sue us.
Now you see the importance of the broadband being paid for under the Clode agreement. That is why MR Gulzar is trying to squirm a way out by saying there has been a misunderstanding, and the broadband is free. If the broadband is deemed to be free, we are not paying for it under the Clode agreement - and Clode have no liabilty to us for the broadband service.
It was reported on this thread this is what Clode have said in the past - that the finance is for the PC only. This is the way they are running.
They are on a hiding to nothing with that one----no where does it say free broadband in any of their documents but it does say free pc in a whole number of places.
Indeed their own contract terms talk of primarilt the provision of the broadband service and if its not maintained you can claim for the unused part. Clode also talks of the provision of their broadband in their terms.
And in your confirmation of the offer it makes it very clear that you cannot get broadband until you've signed the agreement to pay for it.

I Did my recorded delivery letters Yesterday.
I did leave it open on how they respond.
I did mention the fact that I've done nothing wrong. It was the internal affairs of redten that caused this mess.
You dont even have to quote the applicable laws really. They know what they have to do and the time scales that they have to do them in. After seven working days, you do another recorded letter. I expect clode will respond but as for redten I guess they wont bother.
Either way when you send by recorded delivery you can show the courts what action you have taken to resolve this matter.
PS i'm back up to normal speeds!

I have just back in after a busy day and got straight back on line. I have checked and my counter has been reset and now there is a 15GB limit on my conection. Anyone else got the upgrade/downgrade to service, still not unlimited though.Ron.

I cannot see any Court in the land agreeing with them if that is what their defence is going to be. We are onto it. We have amassed plenty of evidence from advertisements to invoices - we got it covered :cool:0 -

Mines been reset as well and I've now got the 15Gb limit as well, it's a bit better but it's not good enough, it's supposed to unlimited.
Still not getting any emails though, which is pants tbh.
Can anybody send me a copy of early contracts/t&c's from deadten as I can't find mine yet, can only find clods one showing broadband & pc package0 -

I am sure that attempting to continue to misrepresent their service and their contract is a double unlawful act on top of misrepresnting in the first place.
If they are now trying to say that they meant that actually the broad band service was free and they were really signing you up to pay over £700 for a £300 PC which they said was worth £500, then clode really have failed in their financial governance.
This is more of a problem for them because the link for ordering the service was on the page saying the exact opposite to what they are trying to say now, and if what they are trying to say now was really true then clode must have known they were misrepresenting the goods and service and thereby breaching the CCA and the ASA and they would be in dead stook because they are governed by the Finance Act --lot more teeth and consequences than OFCOM or the CCA.0 -
