    A few months ago, I was sick of waiting for a Company to complete repairs on my house. So, when I knew the Company was at its busiest - late morning on a Friday - I clogged up their fax by sending faxes for 20 mins.

    3 hours later, there was a knock on the door, and the repairs were completed. The repair man had joked about my "100 faxes". This was an exaggeration, more like 30 :o

    I have sent Clode and Redten my recorded delivery letters AND I have also faxed Clode on 0844 844 2500. I do not have a fax number for Redten as such, but faxed a copy to 0871 855 6331 which was given by Tariq Sharif on a SAVERSTORE.com email with the same address as Redten in Luton.

    I am continuing to fax Clode every day on 0844 844 2500 counting down the days they have to respond before I take legal action.

    If anyone else has fax facilities, maybe they would like to do the same?

    Remember faxes are an acceptable means of communication for the Courts.

    I want broadband I can use. I had two choices.

    Move to Virgin needing to cancel BT Line and dont forget Broadband cant exsist with out a land line : )

    Move to Talk Talk they use LLU so don't require a MAC code.

    BUT

    BT Customer Retentions Department stepped in and did a "internal house move" the order went through without errors.

    I have placed an order for BT Broadband Option 3 they even gave me my email address.

    upto 8Mb/s Free Homehub&phone and will be with BT on the 8th April.

    Goodbye redten.

    All I need to do now is use the full extent of consumer law to end my finance agreement.

    I have not done anything wrong, I was happy with the services until the 10th of March. The internal affairs of Redten caused this. I shall keep paying my finance agreement until I know I can cancel it.

    If you cancel your direct debit you will be defualting on a credit agreement. Take advice before you do that.

    If i need to use litigation I will do so, Consumer laws are there to protect us.

    I agree normanmark - tomorrow is recorded delivery letter day.

    I will send snail mail letters and a copy by fax requesting immediate termination of my agreement and my MAC code.

    Cant believe I have to go through this however. Gutted.
  • Hi, all. Did we get a seperate contract with Terms and Conditions for Clode? or was there only ever one for Redten.

    Just checked the NJPServices account panel.

    We are still on the Home lite package of a 5GB usage and I suspect w will be on that until the 11.4.2008 when you will be given, I suspect, the option of going over to NJP completely and therefore fast4 or taking your mac and going. ( redten would probably want to interpretet that as you voluntarily leaving. )

    However if you want to complain that redten have broken your contract already then you must complain to them and clode in writing, give them now 5 days to respond as they know the problems from all those who have written before.

    If they do not restore your contract terms ( in writing ) then unless you want to go with NJP and pay 19.99 or whatever for home lite request a mac to be given in five days. Claim your money back from clode in witing and move to another provider. If they do not give your mac, ask BT to breech your line to go elsewhere. They will do this automatically if you go to them otherwise have to persuade them.

    Be prepared to lodge a small claims claim against clode if necessary, you can get help with this from citizens advice bureau, local law centres, trade unions, and it can be done online.

    Check home insurance policies or bank current account arrangements as they sometimes include legal advice/assistance for cinsumer problems. If you are paying your monthy payments through your credit bank account then they can recover monies on your behalf.

    You will need to provide very full explanation of how redten have breached your contract and how clode are liable. Again the above agencies can help if you bring all your paperwork to them.

    Me too. I've just finished a lengthy and fruitful phone call with my local Trading Standards people. She took all my details and confirmed that Clode are 'Equally and severally liable' uner the terms of Section 75 of the Consumer Credit Act 1974, as has been noted on this forum before.

    Importantly though, she told me what I knew all along, that I'm unlikely to get out of this contract unless I take some positive steps to do so - ie, use the Small Claims Court.

    To repeat, Clode and Redten are in breach of the Supply of Goods and Services Act (think I've got that right), because I entered into an agreement with them for the supply of unlimited broadband with a free gift of a PC, and this is not being honoured. I've already sent registered letters to Redten, Clode and NJP Services, with the deadline I gave them to restore my unlimited service running out later this week.

    The next step will be to make a claim - I was told this can be done online - via https://www.moneyclaim.gov.uk/csmco2/index.jsp You need to get a 'settlement figure' from Clode, for the remainder of your Agreement.

    I haven't the time to pursue this now, and won't be around until late tomorrow - but hopefully someone else can pursue this line. And who knows, Martin may well have posted some advice for us by the time I log back into the forum.

    No you do not terminate the agreement, or you will be liable for the payments. You advice that they have terminated it by their actions and /or omissions and that as a result you are now withdrawing and seeking your money back from clode to cancel out your debt. i.e. you want them to cancel the debt following the breaking ( and therefore termination )of the contract by redten and that clode has not provided an equal service when they are jointly liable as per section 75 of the CCA 1974.
  • Dont forget to take a copy of the OFCOM news release for submitting to either clode or the small claims court as this outlines the breaches of contract by deadten and clode.

    Just to clarify dave_allen77:

    We have a contract with Redten AND we have a contract with Clode.

    But if Redten breach the contract we have with them, we have further protection afforded by the contract we have with Clode.

    If you look at your Clode contract above the box in which you signed and dated - it's there in black and white:

    The Consumer Credit Act 1974...gives you a number of rights:
    It
    2) If You received unsatisfactory goods or services paid for under this agreement You may have a right to sue the supplier; us or both.

    3) If the contract is not fulfilled, perhaps because the supplier has gone out of business, You may still be able to sue us.

    Now you see the importance of the broadband being paid for under the Clode agreement. That is why MR Gulzar is trying to squirm a way out by saying there has been a misunderstanding, and the broadband is free. If the broadband is deemed to be free, we are not paying for it under the Clode agreement - and Clode have no liabilty to us for the broadband service.

    It was reported on this thread this is what Clode have said in the past - that the finance is for the PC only. This is the way they are running.

    I agree with this; I was took out a mobile contract for 12 months and was supposed to get 6 months free. Once signed up I discovered that the second 6 months wasnot free but you had to use another 6 months and claim the money back after the second month and on a monthy basis to get your " free rental ".

    I made a claim that that was not fair--got fobbed off that they had to introduce that because of the numbers claiming.

    So I faxed the Chief Executive and watchdog using 2 inch high letters written with felt tip pen. ---I had my refund in 10 days and watchdog did a whole couple of programmes on it and housands eventually got their money back without having to go through the monthly saga.

    So plenty of actions still to be taken.
