Just come off the phone to Clode - asking them when I might expect a reply to my emails (sent 7 days ago), and the formal letter of complaint, sent 26th March. Not surprisingly I was fobbed off with a 'you will get a reply' but of course, she couldn't tell me when.

Apparently I need to speak to Redten - now wouldn't that be a good idea!

When I pointed out (again) that my Agreement was with Clode, and that they had clearly breached it, she tried a new tack - 'Our Agreement is just for the Finance - we're not supplying you with broadband'.

I'm not sure how they work that one out. The Agreement tells me that the 'description of goods and services' is 'Broadband and PC Package'. Note '2', a little further down the page, tells me if I receive 'unsatisfactory goods or services paid for under this agreement', I may have a right to 'sue the supplier, us or both'.

Am I being thick? - isn't the agreement for what it says - 'Broadband and PC Package'?

I'll see what Consumer Direct says.

@Andy, regardless Clode are (and I quote statute here) - "Jointly and Severally responsible along with the supplier to the customer".

It doesnt matter that they arent supplying the goods, the Consumer Credit Act 1974 clearly states that both they and Redten are in breach of contract by changing the product supplied without:

    a) informing us or
    b) giving us reasonable notice of the changes

Regardless to that Clode need to start to comply with the law. They are in breach of contract and liable. No argument.

NJP are saying that they only provide the backbone but the actual control of the service is with Redten. They advise ringing Redten to sort out the speed issues....unfortunately my workplace has blocked their number as it is so expensive, any one spoke to Redten about why we have had our 5GB reset but not our speed caps?

I spoke to RedTen this morning, they thought the cap had been removed and that things should be working, strangely enough blamed NJP for the cap.

no mines at about 10kb, even google takes ages to load!
doesnt say i should be charged extra or anything either. same old still 5gb cap, been reset but still stuck on slow speed!

So, if we go over the 5GB in one month, we are throttled on a slow speed ad infinitum?
