  • 32 minutes, 17 seconds. Then it hung up on me!!!!

Didn't even get to speak to someone this time.

Do you get the same strange tone that sounds half way between ringing and engaged about 5 minutes before they hang up? Happens everytime when I phone them.
  • not noticed that but, but I got cut off too.

Phoning Clode now, am sick of Redten not answering.

Clode said that Redten is contactable on the number, so they're going to have some explaining to do if they haven't got in contact with them yet as that was our agreement yesterday.

No I wouldnt say thats a fair proposal I signed up for a contract of service that stated "unlimited downloads" not unlimited service as some use as a get-out, not 5gig, 40gig or even 100gig UNLIMITED DOWNLOADS, I have just found my service has suddenly ground to a crawl so used another access method to log onto fast4 and check my usage, its a 4.936gig so im about to hit the capped limit and already been throttled!! Stuff that mate they want to play hardball they get hardball, after checking our home insurance it looks as if we may be covered for legal action in this situation, going to ring them and double check tomorrow! GAME ON!!!!!

no sorry harlzter you missinterpreted me in what i meant i in now way saying its is fair at all beleive me i have gone through up to 300 gig in a month before with my old server before redten they never had any problem with my usage but my point was well clode are not doing nothing but i see they have to at least sort something out and to pressure redten in at least giving us a bolt on of around say 40gig until they sort out unlimited in a fair set time !!!
now my point was thats offering them a fair solution from us for the time being for say a month period at least and my point is they are not going to pay them ridiculas amounts to njp are they i know they wont pay as much for it as a customer would but it would still smack them in the pocket and also if it went to any action through courts or what ever it would stand in out favour that we hadmade a reasonable offer till this mess had been sorted and i can only take them refusing either clode or redten that they have shown that they are not thinking or honoring the customer!!
now a solicitor can use that offer been made by us to thier advantage can they not at least making the offer on our behalf wouldnt be a bad thing !!!

Does anyone have a copy (scanned or otherwise) of the original (November 2006) Redten and Clode t&c I could "borrow" please.

I am writing an official recorded delivery letter and want to make sure I quote the correct clauses. Alternatively could someone let me have the correct clause for the following:

    1) the clause which states if the service provision changes to a detriment, that is considered breach of contract by redten - think this was in the Clode agreement.
    2) the clause which states that Redten must give us 14 days notice (or whatever it was) of planned downtime or outage.

If anyone can supply me with that information it would be very useful (and I wouldnt have to trawl through 66 pages of posts at work so my boss will be happy too!)
  • 42 minutes with Clode, ooh I love a good argument. Don't think it's getting anywhere as such yet but have agreed that they will phone Redten at 2pm this afternoon and I will phone them back at 4pm to discuss what they have done to get me back on-line.
  • Mac0, accepting an offer in the meantime would put us in a bad postion. It could be seen as a settlement which means that we wouldn't be able to take it any further. Don't accept any offers if you're not happy and wish to pursue it further.

Is there anything in the Clode agreement which would point to it being an unlimited service? I know they say that it only says broadband, but like I pointed out to them it doesn't say alot of things about it, doesn't mean they're not covered under the umbrella of broadband.

They didn't seem to agree with me that "broadband" means the broadband that we signed up to, ie unlimited. Why would it mean anhy other broadband? It's obviously the one we signed up to.
  • no offers. We are be lied to, stonewalled and in effect robbed.

Is anyone talking to the OFT?

Because their using deception to obtain funds.
