  • Ofcom Panel demands action on broadband speeds 7:29AM, Wednesday 19th December 2007

ISPs should adhere to a mandatory code of practice to prevent customers from being misled over broadband speeds, according to Ofcom's Consumer Panel.
The Consumer Panel wrote to the six leading ISPs earlier this year, asking them to explain why customers weren't receiving the broadband speeds they pay for. The Panel was particularly vexed by the use of the phrase "up to", when describing the speed of connections.
Following meetings with five of those providers, the Consumer Panel has asked Ofcom to implement a code of practice that will demand ISPs:
    • Inform customers of the maximum speed available on their line during the sales process
    • Provide clear information about factors that can harm line speeds
    • Contact customers a fortnight after installation to inform them of their actual line speed
    • Move customers to a different package, or even free them for their contract, if actual line speeds "are significantly lower than the package they bought"
Consumer Panel says the ISPs were taken aback by the strength of consumer dissatisfaction with broadband speeds. "They were concerned that we were concerned," Collette Bowe, chairman of the Consumer Panel told PC Pro. "In several of the meetings, I had to point out the type of response that had been triggered by radio interviews on this, where the BBC message boards sprang into life with people expressing strong concern about the issues."
The Panel has also called upon the Advertising Standards Authority (ASA) to review the way broadband speeds are advertised. "My problem is the prominence given to the 8 meg in the typical headline and the very difficult to read caveats around that, that you get right down the bottom of the page.
"I understand the points about 'up to' and why it's very difficult to be more precise," she adds. "But the relative prominence of the attractive offer, and then the much less-attractive caveats that might mean you can't get the offer, is really the issue. It's the way in which it's done."
The Consumer Panel - which is independent of the regulator itself - can't force Ofcom to abide by its recommendations. Indeed, when PC Pro challenged Ofcom on broadband speeds earlier this year, the regulator told us "it isn't something that's on our radar as an urgent issue where consumers are being harmed."
Bowe says that attitudes are now changing at the regulator. "If you said that to Ofcom again today, you might get a different response," she claims. "I'd be surprised if Ofcom didn't do something in response to this call from me."
    Barry Collins

here is an interesting article that appeared in pc pro in december where the panel suggests that people should be released from contracts if they dont receive the speeds they signed up for. A code of practice was called for for ofcom to implement. I know BT has adopted the practice and now quotes speeds at the maximum of consistency rather than the actual soeed you might obtain at any given time.

Again note what it says about advance notice and big adverts as opposed to small obsure print.

for all those that have been saying in this forum and others heres the prices from the members area to mull over i would expect most people on average usage of internet ie radio / tv / watching you tube vids or voip incorparated gaming or using such things like xbox live or the such i would say you are going to need at least 40gig a month bare minimum now see how much just that would cost as a bolt on !!!
and also if you running a webserver or running game comms server or doing buisiness over it you realistically are going to run a bit more than that !!
are you lot saying youd pay these amounts to beat your capped limit ive held this one long enough with out saying anything till now and if you are willing to pay any where near any of these amounts then hey be on capped and take em to court on your savings you dont pay them or better still why dont we ask if clode will pay for a reasonable bolt on to keep us all happy each month of say 40gig thats very fair seeming as thats hardly enough for most people id say it middle of the road would you not agree thats a fair proposal to clode!!! hey i know what they would rather in how much they would loose on would be do you ?

No I wouldnt say thats a fair proposal I signed up for a contract of service that stated "unlimited downloads" not unlimited service as some use as a get-out, not 5gig, 40gig or even 100gig UNLIMITED DOWNLOADS, I have just found my service has suddenly ground to a crawl so used another access method to log onto fast4 and check my usage, its a 4.936gig so im about to hit the capped limit and already been throttled!! Stuff that mate they want to play hardball they get hardball, after checking our home insurance it looks as if we may be covered for legal action in this situation, going to ring them and double check tomorrow! GAME ON!!!!!
