    You can also put your claim through the Financial Ombudsman rather than going through the court system if your claim is more than £2,000, please have a look at the FAQ here...

    i have lodged my complaint with the financial ombudsman now so we'll see what happens next

  • Hi folks, We've went through the different letter templates but as expected the First Trust are saying all fees were fair.
    So have to start court proceedings and have a few questions :-
    1. We claimed for fees plus interest which came to over £2K. For the court proceedings do we have to recalculate the amount removing the interest? Heard we couldn't make an initial claim for interest at the small claims. Is this added on to amount won or is this lost?
    Should we just claim for fees plus interest and let the court sort it out?

    2. We started in Nov so have statements back to Nov 2000 and have calculated on the basis of this - 6 years. If we now get a court hearing in say June 2007. Does that mean we have to recalculate our claim from June 2001? (Is it 6 years from initial claim or 6 years from date of court case).

    3. Has anybody experience of setting up the small claims court appearance?
    We've registered here https://www.courtsni.gov.uk/ so is it simple to set up?
    What documents do you need for your case, what evidence do you have to supply, witnesses?

    4. Is it better to claim to the small claims or the financial ombudsman?

    5. Anybody got this far with First Trust and what was the outcome?

    Sorry for all the questions but I'm a bit of a novice with all this and haven't a clue about court.

    Any help with any of it appreciated.

    this is my first time too and i am challeging the same bank as you from the same time.

    i have taken the advice given by edinburgh lass, and lodged a complaint with the financial ombudsman.

    at least you have got a reply form first trust i still waiting -

    i'll keep you informed how i get on, will you do the same.

    my fees were 3359 but because they did not reply on time i added the interest - 4400 odds

    i sort of knew they wudn't pay up so am prepared to takr them all the way.

    i email them every few days - contact name lorraine.whitsitt:aib.ie , she asked me to ring and i told her i preferred all my correspondence in writing - haven't heard anything since.

    Coupla guys I work with from London did it and got there money back after a few letters.
    So we are having a try.
    Just followed what those guys did which I'm not sure was right as I have tried to claim for every fee that I have been charge not just what is above £12.
    They told me it was all illegal but now reading round these threads I'm not sure if I can claim for everything or just what is above £12?
    What did you claim?
    Ours is for £2800 but that's with interest.
    Now that they have turned us down I may need to go back through the fees and just claim ones bigger than £12. Can they prove the lesser fees are legal??
    Not sure what to do next. Adjust our claim or go through proceedings as it is.
    I'm in a union so we are going to see a solicitor for free for some advice.
    Don't mind getting something back even if it's not the full whack.

    I am trying to claim back from First Trust.
    I have checked the "What can be claimed" link but i am not savvy enough on banking matters to understand how they relate to what i have been charged

    I have the following charges on my account:

    Direct debit set up
    Interst charged
    Referral Charge
    Fees for going overdrawn
    Fees for going over overdraft

    Also there are fees that were charged for having a packaged account but i think that i can't claim for them. If i am wrong please let me know!!

    Can someone please let me know which of these i can claim back for?

    Would appreciate any help.

    have posted here before but can't seem to find it, I'm a total technophobe!!! Anyway have tried to claim almost 4,000 back from bank but got a letter today saying they have a right to apply charges and my claim has been rejected and this is their final decision so I should go to Financial Ombudsman if not satisfied!!! should I phone? write? go to court? but here in NI the max in small claims is 2,000 and don't want to go to High cOurt - the thought terrifies me!! what do I do? was really holding out on this money! This is a joint account for me and hubby!

    Has anyone or is anyone claiming back bank charges from First Trust bank in Northern Ireland? Has anyone been successful or knocked back?

    I am currently in process of claiming back charges. It took them 6 weeks to send out statements (They claimed the first lot got lost in post) and after first letter demanding a full refund they didn't reply within 4 weeks. I then got a letter saying they need another 4 weeks to 'complete their investigations'.

    I have written to them saying this is unreasonable and if they don't settle within seven working days I am taking them straight to court.

    I fully intend to do this rather than waiting for them to 'conduct further investigations.'

    Anyone else like to share their experiences with First Trust>?

    I don't think any of us from NI will have alot of luck as the head judge has suspended all bank charge related small claims until further notice
