I havent read of anything like this before. Or do i just go ahead and fill in my small claims court form and just send a letter to Ulster Bank and tell them im taking them to court?0

Help please
i am trying to claim £689.36 incl interest from Natwest i have created an account on https://www.courtsni.gov.uk but once i entered the details of bank the next screen asks date claim arose?
is this the date of the first default charge reclaimed.
Interest do i add interest from calculator and do i recalculate this since 28 days have elapsed since first letter was sent?
what wording do i put in details.
please help as most of the posts i have seen refer to moneyclaim online and the law in england not the anomalies of Northern Ireland0 -
Hi
The date claim arose is the starting point of your 6 years of which your claiming for. Keep your figures as per your first letter!
This was the details of my claim, minus the obvious details!
Claim Description
1. Between 19/04/01 and 29/01/07 the Defendant applied numerous default charges to the Claimant's
bank account. It is understood the Defendant contends the charges were debited in accordance with
its contract with the Claimant.
2. The charges applied are an unfair penalty under the Unfair Terms in Consumer Contracts
Regulations, which state: "A term is unfair if it requires any consumer who fails his obligation to pay
a disproportionately high sum in compensation". The amount charged does not reflect the cost of the
breach.
3. Under the law of penalties, the charges are an unlawful 'extravagant' penalty. A charge is a penalty
if it does not reflect an item's true cost.
4. Under the County Courts Act 1984, the claimant is entitled to interest at a rate of 8% per annum
from the date they were first deprived of the money. This totals £229.59, continuing to accrue at the
statutory daily rate of 0.021% until judgment or earlier payment.
5. The Claimant therefore asks the court to enter judgment in their favour for £978 plus interest,
totalling £1207.59
Hope this helps0 -

You can claim for 6 years however you will not be permitted to claim over the £2000 limit and the courts service are on the ball and won't allow multi claims for the same account!
Go for the £2000 Good Luck!0 -

6 years but like Scotland as you are limited to the amount you can put through the NI court online, please have a read of Martin's article regarding putting your claim through the Financial Omubudsman. You can pass your claim to the FO after you have been dealing with the bank yourself for 6/8 weeks.0 -
Hi there, I have just sucessfully reclaimed £3246.13 from the Ulster Bank. I had to go to the small claims online facility, but I think you will agree, it was well worth it. First Trust are proving more tricky, but I hope just posturing. Keep at it, they know they are complete charlatans and they hope you will give up, DO NOT, sue the mothers! TraceyS
Can u help me? i thought here in NI that you couldnt claim more than 2k?0 -

I'd drop it into the branch and ask them to send it to head office.
Alternatively the head office details will be in the phone book.0
