i counted up the charges the FIRST TRUST bank took from my account, and from the statements i have i estimated they owed me over £4000....yes £4000 !
so i sent them a standard type re-claim letter i found on the BBC web site. after about 6 weeks they wrote back saying that as far as they are concerned they owe me nothing and that if i have a complaint, to go to the financial ombudsman.
surely they owe me something?
counting up the bank charges on the statements i have they owe over £2000 alone, so i estimated the rest.
does anyone here know the procedure i should follow or what i should do next?

Follow martin's advice on here and use the templates etc in his article

It happens all the time - the banks just think if they say no or offer you less you will accept they are right!Got It & Spent It :dance:IKEA CARD = £120 charges = £175 received (146%)MARBLES = £450 charges = £370 received (82%)I.F. = £494 charges = £494 received (100%)CAPITAL ONE = £981 charges = £1,489.03 (152%)BARCLAYCARD = £580 charges = £786.12 (136%)On Hold :mad:A+L = £722 charges (target = 147%)BARCLAYS = £1,405 charges (target = 128%)BARCLAYS = £175 charges (target = 140%)ABBEY = £3,220 charges (target = 148%)0 -
I've shifted your thread into this thread as you'll find an email contact for First Trust in the posts above.
However, my advice to you is start at the beginning using the templates in Martin's article and ask for the statements/information and DON'T estimate your charges as should this come to court you then have no defence to take to court.0 -
This is just a bit of warning to future claimants in Country L'Derry. 99% of judges will just decide in your favour with no problems. However the L'derry district judge fall in the 1% unfortunatly.
After relisting the week before court I finally had my day yesterday. £1000 + £200 interest. As predicted the defence solicitor did not turn up, 99% of judges will just give judgement for the full amount with out any problem but not this guy. He went through the entire court bundle, went through every charge, asked me about the OFT summary. Then decided to devide the number in half and not allow for interest, so instead of £1000 I got £500, and he says I am lucky to get that, however the defence had made me an offer of £800 previously so he changed it to that.
He said I was very very lucky to get that. He says you can not expect free banking hence how he arrived at his £500 figure. Now please bear in mind this is a Friday afternoon with no defence solicitor. Had it been a Monday morning wiht a defence solicitor I do believe I would of got nothing.
So anyone based in County L'derry please gow down the F.O route for your charges.

Hi
Getting Frustrated trying to old out to c what bank offer. N.Ireland small claims court amount £2000. My bank charges are 6000. Can both parties of joint account file to seperate claims to small claims court for the same account. Please let me know!!!!!!!!!!
Feel like giving up getting no where0 -
I dont think so. Also my understanding is if you file more than one claim at a time for the same account the court will put them together which will take you over the £2000 allowed for a small claims then you would have to pay more.0

As you have a limit in NI on what you can claim I would advice you pass your claim over to the Financial Ombudsman as above, check Martin's article regarding using the FO.0 -
This may be a silly question and I cannot find if it has been asked before.
The Small Claims Court in NI is restricted to £2000. I have a joint current account with my other half. We have more than £3000 to claim back from our bank. Can we split this claim into two separate claims, one for each of us?
Your thoughts on this would be appreciated.0 -
I am very surprised that of all the well versed claimers that subscribe to this forum that none of them can answer this query:mad: On the other hand this posting did not stay too long on the first couple of pages because of the number of members who appear to be asking questions that are answered in Martins Bank Charges Schedule, if they had bothered to look:T
Maybe someone out there will know the answer but I'm not holding my breath0 -
Hold your breath no longer...speaking for myself I have had other things to do this afternoon, like earn a living
You can't have 2 people claim from the same account but should your claim not be settled I would suggest you take your claim to the Financial Ombudsman in the same way many Scottish claimants have done due to the restriction on the small claims amount.
You can read about the FO in Martin's article and the FAQ here..
