  • Sorry forgot to add the letter from the solicitor seems to be making an offer of settlement sorry 'ex gratia' payment on the proviso that you don't go back and try to claim more charges for that period of time your claim was originally for and you would have to agree to keep the details of your settlement with them completely confidential! By offering an ex gratia payment the bank is not accepting that your claim is lawful it is simply offering you the money out of the goodness of its heart!
    You can make another claim from February and still accept the offer.

    Just the advice I was looking for about complaining to the Ombudsman.
    I have won two lots of charges from Halifax, who piled on the charges whilst
    my first claim was with the Court. They ignored my letters asking for a breakdown of their charges. They have apparently paid the funds I claimed through
    MCOL (they acknowledged the case but later wrote it would cost them to
    defend it) and paid them into my account. The account has credit and no debts yet I cannot access it. I believe the word retaliatory will be very
    useful. Thanks.

    I have complained and i recieved a letter from them saying, that they will not reopen my account but have offered me £250 as compensation :beer:

    All I did is copy all my letters to them and they crack on.

    I have just received a letter from the FSA offering me £250 from nationwide as compensation. It is worth doing lol :beer:

    I thought I would post an update to my situation, its been a while!

    Well before I could contact Lloyds with my I&E, I got a letter telling me my account had been put in collections.. no surprise there, I guess. I finally got someone to listen when I phoned them that day and offered them a payment which they accepted. <sigh of relief!> By now my CC with them had been transferred to another CC at another bank, and I had closed another account I had with them that I never used, but had a £30 charge on it.

    So I went ahead and tried to claim the £30 charge on the account and £92 charges plus interest on my CC. The £30 was refunded with a pleasant letter, but I got a stroppy letter back for CC telling me basically I was being unreasonable trying to collect charges back for that as they didn't charge me much to use my card, etc etc... yeah right. So today they are being sent the second letter.
    As for the main account, I held off a little on that, unsure about whether it would upset the reduced payment agreement I made with them ... the charges only really come to around £200 so I will wait a little until my financial situation is a little better, and I'm in a better position to cope with any backlash.

  • i have been made an offer by nat west for my charges,however,i do not have an account with them and owe them money,which is being paid back to them via a different method,does anone know if i can insist on having the money paid back via cheque,or does this money have to be paid off what i owe them?

    As long as your payments are up to date, you can insist on payment in full by cheque.

    I have an old/closed account which was with Yorkshire bank. They have put a default notice against my credit file & obviously closed the account. Although i paid the notice, will i have a chance getting it back?
    I have sketchy, incomplete amounts of statements etc re: the charges & called them for copies which they refused to supply......
