    Yes, both accounts are with NatWest. One was my old student account which is very overdrawn and the other more recent account which the charges would just about cover if they were to close that one...

    We shall see what happens. If I were to open a parachute account, then I don't think they would take 1800 straight away! Can't have that frozen!!!!! :D

  • i am about to take hsbc to the small claims court but a little worried that they might close my account, i have a rubbish credit rating cos of a credit card ages ago and could only get a saving account, i have a personaly loan with hsbc and a credit card, i dont no what will happen to them if they closes my account cos i cant have direct debts from my saving account

    I would look at moving to a new bank account, and then you have the worry of "what if they close my account down" taken away from you. If they do, they do! At least you've moved your DD's and SO's and your less likely to get further charges for these being suddenly cancelled. If you leave behind an overdraft, then they will have to accept monthly payments to repay it and at least if your not having wages/benefits paid into that account, they cannot just take whatever amount they feel like.

    I had a very bad credit rating, and managed to get a basic bank account with the co-operative, who have been great. I get only a basic bank card which most shops accept now, and online/telephone banking which is great.

    Once this is done, it then leaves you to concentrate on the complaints procedure and getting your money back!
    I would defeinately say that going to the Information Commissioner/Financial Ombudsman is no quick fix. Indeed they state that they cannot actually do anything to the banks for threatening or actually closing accounts as they do have the right to withdraw banking at any time, but in my experience, if nothing else, you can get some compensation from banks which you otherwise wouldn't have rec'd.

    I would still speak to their own complaints departments though, as the people in those departments seem far more aware of the correct procedures, take things less personally and will usually get you the statements fast and let you know where things are up to. Dont be frightened of speaking to them. I wouldn't bother with the normal customer service numbers though as generally speaking, they havent got a clue.
    Obviously, this is just an opinion based on my own experiences. biggrin.gif

    I don't know if anyone can help here but I'm claiming on a joint account and to be honest my/our credit rating is so poor (mostly thanks to the charges judging by the statements I received) I've had trouble opening a new account elsewhere. We're currently with Halifax and between the pair of us we're bringing in just short of £2800 a month into one account and just short of £500 into a savings account. anyone got suggestions?

    Hi everyone ,I am new so I hope that this is in the right place.

    I am in the process of claiming my charges back from HSBC. I have refused their offer of £3,200. as the amount due is £4500.I have returned a letter to say that I will accept £3200 as part payment.I received the offer just as I was about to lodge with Moneyclaim.It all on line I just have to submit.

    I went into the bank today and the Manager withheld my card as the account was not being operated properly!!
    I explained that I was in the process of reclaiming my charges and that I was checking the progress as I would be away and also I was concerned about the postal strike.

    Now the money will be paid into my account and I am only able to access my own money with a withdrawal slip.I told her I was a very unhappy customer and that i was being penallised because I had reclaimed my charges. No, she said that all customers are dealt with on an individual basis.

    I said I would report the matter to the Financial Ombudsman as effectively she has closed my account, and will probably demand that the overdraft is repaid £1600, which would have been repaid when the claim went through.

    Sorry that this is so long - please help.

    Well has your account been operated properly? From the bank's POV ISTM that the majority of the charges you have suffered must have been imposed before the unlawful subject came up, Therefore again imo we have a certainty, namely that you misbehaved and so the bank has a good reason to close your account. This, at this time, is placed against a *maybe*, that all the charges are in full unlawful (AFAIK no one has said that, only that they are unlawful at the current levels). It also appears that the refunds made by bans through losing cases havebeen for not appearing.

    TBH, If the ombudsman or whatever accepts previous delinquency as a valid reason for refuting claims for wrongful closure such as yours it would not be something I would cry over

    Try Royal Bank of Scotland :) I did it all on-line and I have a very bad credit rating (due to all the charges I got off Abbey - 5 years ago!)

    I have a £20,000 loan with HSBC, and am just about to start DMP with CCCS (who advised me to get another current account, as HSBC can take my monthly loan payment if I go to DMP, but will also act as a safeguard if they close the acct when claiming charges too)and claiming my bank charges of £600.00. I have applied for a Halifax current account in case they close my HSBC account, but wonder if they can demand payment of my loan in full or is this a separate agreement... i.e nothing to do with my current account???

    If anyone has had similiar?? If not, i will keep the forum up to date when and if anything happens :confused:

    It is a seprate agreement. :)

    But if you have late payment charges on it you can claim them back too ;)

  • :jI claimed £1,200 from Lloyds TSB in April. After getting a couple of letters from their solicitors and fighting all the way I finally had an offer last week to repay what I was asking for. I haven't seen the money yet, but I do have a solicitors letter promising it to me, so I am sure I will get it fairly shortly.

    The reason I am praising them is that after admitting defeat, one of the conditions of the charge refund is I must meet with my personal bank manager this week to sort out the borrowing on the account and to generate a loan or a larger overdraft limit to keep the account in order. Fair play to them - they get to keep a customer, they get to charge me (legitimate) interest for my overdraft and apart from the £1,200 they have to repay me, they have actually come out of this without losing anything. A bank that sees sense.... now there's a thought!
