BUT the buyer is saying to ebay its 'not as described' in terms of being used, not that it isnt the interactive version though. Very different issues.
Its quite clear that she thought she was buying the interactive version, but thats not the reason shes raised with ebay. Whoever is in the right or wrong, on this basis you may have to refund.
Are you not worried that she will 'dirty it' and send it back to you? then you will have to refund her anyway (minus her return tracking/postage), and then you will not be able to relist it as new!
Both of you could loose out.
Hindsight, as they say, is a wise man. If I was selling anything that could be mistaken for a similar but more popular and expensive item, I would personally clarify it in my listing. But then I am one for belt and braces.
Similarly if I was selling an MP3 player without the earphones, I would state it would not come with earphones, and not ssume the buyer would notice the lack of the word 'earphones' from the description.
She is claiming it is used now, yes. BUT as eBay will be able to see from her messages, her story has changed several times now on why she should get a refund with her eventually admitting she'd made a mistake & thought she was buying the interactive bear, DESPITE my listing making no suggestion of this.
In regards to the MP3, I listed the items included in the sale, such as player, charger, discs etc. Nowhere did I mention that the earphones were included. I think eBay buyers really need to stop making assumptions, & READ descriptions tbh. Nobody says "hindsight is a wise man". Because it doesn't make any sense. Nor does your mp3 example. I've sold loads of players, no earphones, without pointing that out. I just list what is included.
You don't list a tv and say it comes without an aeriel. Or a bed and say it comes without bedding.0 -
OP I hope eBay see sense and rule in your favour. Do Toys R Us list all the different Lotso toys with 'BTW this is not the all singing, all dancing version'? No they don't, so I don't see why an eBay seller would have to. As long as you describe an item for what it is then what's the problem?0

ebay listings have a description for a reason, so you can see what you are bidding on AND if you are unsure there is a 'ask seller a question' button. she should quit her moaning and learn to read properly instead of pinning the blame on the OP. i would stand my ground on this one...she could be trying it on and may give in when she realises you won't back down.

She's getting worse. She's now monitoring my other auctions & accusing me of profiteering even though the auction she's referring to was actually ended early by me on Sunday without a sale even taking place! Is she contacting you via the Ebay messages? If so, contact Ebay and tell them she is harrassing you. This sort of behaviour is not on. I hope you have her blocked already.0 -

She's doing it on the dispute so they'll be able to see it. But i've reported her anyway for harrassment. This is getting ridiculous now. I know she's hoping i'll get fed up of her & just offer the full refund, but it's having the opposite effect!
