Am I in the wrong??

OP - I don't think you're in the wrong. I think there are some very peculiar buyers out there though.:(
Every so often I have a tidy up at home and sell some stuff and spend ages getting the description spot on. Recently I sold a new & unworn top which is in a crinkle fabric and I said so in the listing. I posted it immediately they paid and they left negative feedback saying it looked like a wet dishcloth and was badly creased. Honestly you can't win!
Just after that I sold a small pottery item for £2. Again I got left negative feedback because in her opinion it was badly thrown. I didn't make the flipping thing did I?

She did, giving me every line in the book until she eventually admitted she'd messed up! Any update, or still waiting for them to decide?"There is no medicine like hope, no incentive so great, and no tonic so powerful as expectation of something better tomorrow." - Orison Swett Marden0

Well they came back & said its not harrassment because she's not threatened me....I'll have to bear that in mind in future. I can stalk someone as much as I want as long as I dont threaten them.....
With regards to the claim, I can't escalate it to eBay until 21 December as that is when the 10 day period lapses. Have no fear, I WILL be escalating it before she gets the opportunity to!COMP WINS FOR HUBBY & I SINCE SEPTEMBER:2 £50 DOMINOS VOUCHERS, 13 PAIRS OF FOOTBALL TICKETS, MICROSOFT HOME EDTN, 2 PAIRS OF ALTON TOWERS TICKETS, 1 CASE OF PERCY PIGS, 1 PAIR OF LEATHER LADIES GLOVES, 4 COLLECTION 2000 PRODUCTS, PLAYSTATION 3 WITH FIFA 12, 5* HOTEL STAY IN LONDON, SEASON 6 OF SUPERNATURAL DVD, PERFECT PIZZA VOUCHER0 -
I have never sold anything on e bay and prob never will, and do a lot of buying on e bay, but I am on the side of the OP all the way.
For one thing if I had been looking at this particular bear, with there being no mention in the description that it was the all singing all dancing version, I wouldnt have assumed it was.
But even if I had won an auction on the item because I had ASSUMED it was something it wasnt, I would certainly not have had the brass neck to expect the seller to refund me. It would be my mistake, not the fault of the seller.'If honour were profitable, every man would be honourable' Thomas More

Seller is in the right, buyer is in the wrong.
OP I hope you win the case and can move on.
If I make the CHOICE to bid over the odds on an item which isn't even the item I want, then that's my own stupid fault.
What more could the OP have said on the listing but the truth, which is what she did?Tank fly boss walk jam nitty gritty...0 -
And the saga continues. More messages from her today where yet again she admits she thought she were buying the interactive bear. I shall be very disappointed if eBay rule this in her favour, given the number of times she's come up with a different excuse for wanting a refund. Apparently I should get off my high horse & stop being so defensive. I merely pointed out that there is more than one Lotso bear on the market, which she doesnt seem to appreciate. She keeps insisting mine is a fake as its not interactive. I apparently went full steam ahead & let her pay too much for it.....COMP WINS FOR HUBBY & I SINCE SEPTEMBER:2 £50 DOMINOS VOUCHERS, 13 PAIRS OF FOOTBALL TICKETS, MICROSOFT HOME EDTN, 2 PAIRS OF ALTON TOWERS TICKETS, 1 CASE OF PERCY PIGS, 1 PAIR OF LEATHER LADIES GLOVES, 4 COLLECTION 2000 PRODUCTS, PLAYSTATION 3 WITH FIFA 12, 5* HOTEL STAY IN LONDON, SEASON 6 OF SUPERNATURAL DVD, PERFECT PIZZA VOUCHER0

What a dense fool you're dealing with! :rotfl:
If yours was interative, it would have said so on the listing wouldn't it!
I really hope they don't find in her favour, fingers crossed!Tank fly boss walk jam nitty gritty...0 -
At least Ebay havent frozen your account while they "investigate". My friend sold a pushchair, received positive feedback and everything was good. A couple of weeks later Ebay froze her account (and funds) as they have received a complaint from the buyer that after using it however many times that the front wheel fell off so they would like a refund - at her expense. It dragged on for months as she refused.0

They may as well have. I can't buy or sell because Paypal are holding the amount she paid, so my account is in negative balance. If I sold anything, it would be eaten up by the negative balance & I can't buy anything without clearing the negative first.COMP WINS FOR HUBBY & I SINCE SEPTEMBER:2 £50 DOMINOS VOUCHERS, 13 PAIRS OF FOOTBALL TICKETS, MICROSOFT HOME EDTN, 2 PAIRS OF ALTON TOWERS TICKETS, 1 CASE OF PERCY PIGS, 1 PAIR OF LEATHER LADIES GLOVES, 4 COLLECTION 2000 PRODUCTS, PLAYSTATION 3 WITH FIFA 12, 5* HOTEL STAY IN LONDON, SEASON 6 OF SUPERNATURAL DVD, PERFECT PIZZA VOUCHER0
