If the buyer is insiting it is a fake - then shouldnt she be the one gettign proof from Disney heheh (might kick her over the 90 day limit she can claim) hehe

    The limit is 45 days.

I've lost track if it's an Ebay or Paypal dispute in this thread, but for Ebay disputes the SELLER needs to prove authenticity and for Paypal the onus is on the BUYER to prove it's a fake.
  • Its an eBay dispute. They've not asked for any proof its authentic. Although i'm hoping they can see from all her messages that the real reason behind this is because she wanted the interactive bear.

  • ah - maybe im thinking of charge backs or maybe im way out of the park and confuddled with the 90 days?

If she's admitted it babyfruitella in messages then its a bit hard for her to back track now x

eBay disputes can be less predictable than Paypal ones. I only learned of the difference in responsibility of proof when Crownqueen updated one of the threads a couple of days ago. I had thought they were the same as Paypal. If she didn't file a fake dispute then I suppose that is immaterial. Ridiculous that they have different burdens of proof.
  • How long should I leave this before I get back in touch with them? Its been over 72 hours & I've heard nothing from them. I don't want to ring them in case they see their backsides with me & rule in her favour lol!

  • Just a quick question to throw into the mix - if this had sold for the going rate of a non-interactive / standard bear and the buyer had changed their mind would you have refunded? A couple of times buyers have requested to return an item (usually clothing that doesn't fit). As long as I am not out of pocket for their error then I don't mind. However if someone paid well over the odds and I realised I probably wouldn't get that price again would I refuse and stand my ground?...hmmm
  • No, I wouldnt have refunded if she said she'd changed her mind either. If she didnt want it she shouldnt have bid. As it goes, she's changed her mind on this occasion because she's realised she bid on the wrong item. This wasnt a buy it now item so Distance Selling doesnt apply, & this WAS the going rate of one of these bears. I watched one end not a few hours before for more or less the same price.

Fair enough - guess I'm a bit too soft sometimes. ;)

  • Keep on at them. I had one from November which had full tracking and cop uploaded but took a month and half a dozen phone calls to close.
