The buyer made an honest mistake, would have been much less hassle if you had accepted that mistakes can happen and settled with the buyer before it got to dispute to be honest. We could argue for weeks about whether the buyer was being stupid or not, whether you described the item correctly or not, but fact remains that they got confused, bought something in error, paid way too much for the item as is, so understandably would like their money back...I'm sure you would too if you were in the same situation.We have removed your signature - please contact the forum team if you are not sure why - Forum Team0

I've spoken to eBay now. The guy was very helpful. Looked into the case, & said I have a good case but have to wait for the 10 days to lapse. Hopefully either way the buyer will learn a lesson - know what you're buying and read the description / look at the pictures! Only last week I had a garland listed - had the measurement of the length stated 8' 6" then had a question from a potential buyer 'Is this garland 9 foot long?'. Deep breath and calm reply...0

why should she have to give a refund!!! she listed what the item was and showed a clear photo...the seller ASSUMED it was something else and is therefore a idiot and should have paid more attention to detail! i hope ebay rule in your favour OP!The more one gets to know of men, the more one values dogs.0

But this IS the buyers error!! "they got confused" Maybe that £34 (£30ish after fees remember!) is whats paying for Christmas dinner for the OP?? It would have been less hassle if the buyer had just read the auction and not assumed what was for sale. The OP is under no obligation to refund...in the same way as it the biyer had bought it from a shop and changed her mind, the shop would have been under no obligation to refund.

BUT the buyer is saying to ebay its 'not as described' in terms of being used, not that it isnt the interactive version though. Very different issues.
Its quite clear that she thought she was buying the interactive version, but thats not the reason shes raised with ebay. Whoever is in the right or wrong, on this basis you may have to refund.
Are you not worried that she will 'dirty it' and send it back to you? then you will have to refund her anyway (minus her return tracking/postage), and then you will not be able to relist it as new!
Both of you could loose out.
Hindsight, as they say, is a wise man. If I was selling anything that could be mistaken for a similar but more popular and expensive item, I would personally clarify it in my listing. But then I am one for belt and braces.
Similarly if I was selling an MP3 player without the earphones, I would state it would not come with earphones, and not ssume the buyer would notice the lack of the word 'earphones' from the description.0
