As i have said i operate in the manner where the landowner is totally in charge. Infact i cancelled a ticket today because the person in concern parked in a no parking area with no permit. he claimed to be allowed to park there. We knocked the pub door to ask but the landlord was out. I said if he has permission to park there i will just cancel the ticket. I went today off my own back (not after getting any contact from the driver or landlord) but off my own back to see if the man was correct. he was and has now been given a permit and his ticket has been cancelled by me.
(and i think no typos :P)
I think not!You mean 'off my own BAT' (not back). Lots of people get that phrase wrong but it drives me mad I am afraid, it's a sporting term originally, nothing to do with your back...
Anyway I have just caught up with this thread again and find it impossible to believe that ANY PPC allows even 5% of 'appeals'. There is no 'appeals' system to a private invoice, your industry pretends to have enforcement powers that simply do not exist and the way that PPCs blag their way into getting people to pay is by using yellow envelopes, codes for so-called 'contraventions' and by otherwise copying the appearance, typeface and phraseology of a real Penalty Charge Notice.
But your fake 'ticket' is not a real fine so we will of course tell people to ignore!
If the '40% successful appeals' figure you suggest were the case - even for one PPC operating at Universities - I really believe the info would be out there in the public domain, there would be examples on the internet of Partnerships like yours allowing appeals. But allowed appeals by PPCs are like hen's teeth, in 3 years of frequenting this forum and pepipoo every day I think I have seen TWO examples of a PPC allowing an 'appeal' (and they were because a retailer told them to).
And did you not know that a disabled person can use a service-provider's disabled bay even if they have NO Blue Badge? It's called the DDA (now the Equality Act) and here's the definition of who can use disabled service 'reasonable adjustments' (having a blue badge does not come into it, strangely enough...):
http://www.direct.gov.uk/en/DisabledPeople/RightsAndObligations/DisabilityRights/DG_4001068
HTH, even if you just take on board the bit about the DDA and no Blue Badge being needed that would be a start as PPCs break the law in this respect every single day.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

My use of the word 'fine' was in quote marks as I am merely using the misleading and unlawful language of PPCs. Your decision to cancel some tickets is not as magnanimous as you imply, you are merely cancelling the unenforceable. As for the day when PPCs have the law on their side, dream on. The law that you crave will be proposed by Godot and seconded by the Tooth Fairy.Still waiting for Parking Eye to send the court summons! Make my day!0

PRIVATE PARKING TICKETS - DON'T PAY!
IT IS NOT A FINE! YOU HAVE DONE NOTHING ILLEGAL!
This is an information page for the thousands of people who receive "tickets" from private companies in the UK ever day at supermarkets, retail parks, and in any other privately-owned carpark.
We are NOT encouraging anybody to openly flout parking restrictions on private land, or to refuse to pay reasonable charges for parking. Landowners have a right to make reasonable charges for the use of their land.
For advice specific to your case, you should visit the forums at http://forums.pepipoo.com or http://www.consumeractiongroup.co.uk/forum/parking-traffic-offences.
http://forums.moneysavingexpert.com/forumdisplay.php?f=163
1. What you should know about these companies
It is important to remember that private parking companies (or PPCs as they are often called) have NO OFFICIAL POWERS - that's right, none at all! They give out their "tickets" on the basis that you have seen the signs in their car park and that you have therefore agreed to a contract obliging you to pay a certain sum of money.
2. What happens to people who don't pay?
In 99.9% of cases, absolutely NOTHING! The company pays the DVLA £2.50 to get your address, and then sends lots of threatening letters. In the main, these letters can be safely IGNORED. The only way the company can actually force you to pay is by taking you to the small claims court, which costs them even more money. And they are by no means guaranteed to win! And they practically never do.
The two main reasons for this (among others) are the following:
- Only the person DRIVING the car could ever have agreed to any such parking contract. The company can only get the Registered Keeper's address from the DVLA: you don't have to tell them who was driving.
-Many of these charges are so extortionately high that they constitute a penalty, which is unenforceable in a consumer contract.
3. Can they affect my credit rating?
NO! The only way your credit rating could be affected by ignoring private parking companies is if you were taken to court, lost, and then still refused to pay. But they will not take you to court.
IN SHORT
The vast majority of the time, you can safely IGNORE tickets from private parking companies, they are not official fines.
The vast majority of the time, you can safely IGNORE the threatening letters, including those from debt collection agencies.
You DO NOT have to pay a penny of your hard-earned money to these companies. Remember that the chances of being taken to court are very slim indeed.
DO NOT IGNORE COURT PAPERS!
If you receive real court papers from a private parking company (very rare) then you should go to http://forums.pepipoo.com or http://www.consumeractiongroup.co.uk/forum/parking-traffic-offences for help defending the claim. Do not be afraid to sign up and ask questions regarding any paperwork you are not sure about.
Don’t believe the above? Watch a solicitor on Watchdog advising you what to do with the scam invoices.
http://www.youtube.com/watch?v=XAIcdi9niHA
THEY ARE NOT FINES
Only the Police, Courts or Council’s can fine you. NOT a private company, please remember that.
Even my post as been mod edited now. Why? There was nothing wrong with the post.
It would appear, i presume, the PPC's don't like me sticking printed copie's of the above info on thousand's of cars in supermarket car parks all over the place. Tough.
It's going to be three thousand before the week is out now. I would urge people to please print the above off and when you are in a nice big car park, leave dozen's upon dozen's on cars. It is obviously working and they don't like it, again, TOUGH.
It's a method they can do ABSOLUTELY NOTHING about.
Let's hope the weather stay's dry after Wednesday when i have four day's off. There will be more pic's than these.

So what PPC Company do you run?
If you are as ethical as you say, then you will have no problem promoting your Company.0 -
Good for you Driver8. With a little more push from all of us, the PPC gravy train will be derailed. They brought it on themselves.Still waiting for Parking Eye to send the court summons! Make my day!0

I think you are right you have no need to give your company details here, as we also have the right to anonymity
At least you had the gonads to state your position from the outset, unlike some others who have not and prefer to Troll!
Merry Christmas, but excuse me if I dont wish you a prosperous New Year.;)0 -
I think the best 'revenge against the PPCs' was when the 'Food Company' opened in Marks Tey. They placed signs threatening wheel clamps in use. Trouble is, the Planning Permission conditions granted only allowed them exclusive use of 12 parking bays out of the 40 available.
The rest were for 'The use of customers using local shops' and that 'The car park must be available for use at all times the other local traders are open'.
The local shops and the Parish Council (whose notice board is right by the car par entrance) all posted large notices to the effect that the Food Hall car park was not exclusively for the Food Hall.
As an aside, the local wine merchants and the Post Office shop both open from 6.00am - 9.00pm, but the car park is only open from 7.00am - 6.00pm. If my car gets locked-in, then I will assume I have a right to remove said barriers as they are illegally preventing my exit from said car park.Never Knowingly Understood.
