I personally think that if there are two families in need (the OP's mother and brothers, and his fathers' parents), then the father should come back and support his OWN family.
It would be nice to be able to support both families, but this is not possible so the OP's father's first responsibility is towards his wife and children, NOT his parents.
It is not right that he has gone and left his family with nothing and then expects British taxpayers to fund the bill.(AKA HRH_MUngo)

The british tax payer was already footing the bill - the family were living off of his fathers incapacity claim. Incapable of work but capable of caring for a paralysed woman who is losing her mental capacity too - sounds like he'll be giving more than "moral support" in those circumstances.
OP you need to be on benefits to get a crisis loan!!! You seriously need to look into benefits criteria some more before posting any more ridiculous statements about not knowing there was a high rate DLA (hint, it's detailed on the book you get with the form), I've posted about tax credits twice before you said you didn't know what they were ever heard of google?
Also on your first thread you were pointed towards entitled to, that asks about rates of DLA people in the house are receiving and also gives details of tax credit awards.0 -
OP- your mum should be entitled to claim Income Support as she falls within 'a prescribed category of persons' eligible under para 23 of Schedule 1(B) of the Income Support General Regulations 1987:
Member of couple looking after children while other member temporarily abroad
23. A person who is a member of a couple and who is treated as responsible for a
child who is a member of his household where the other member of that couple is
temporarily not present in the United Kingdom.
You can point them in the direction of para 20181 of their own 'DMG- decision makers guide' for accessible confirmation of this category.
The age of the child/ren isn't relevant for claims under this category as it is for lone parent claims.
She should challenge the Income Support decision by requesting a 'revision' in writing identifying those grounds (I'm not sure how long ago the decision was made but the one month time limit for challenging decisions doesn't apply when there has been an error of law- it's known as an 'any time' revision). I think the OPs father will have a damned difficult job re-claiming any incapacity benefits when he returns from abroad.
And quite rightly so too.
It is not British taxpayers job to support a Turkish family who after 20 years hasn't even bothered to learn the language.
Can she not return to Turkey with her husband and claim benefits from the Turkish government? At least she will understand form filling a little easier.

Isn't there a minimum age that a child has to be before a parent can claim IS? I believe the younger child is over that threshold therefore she won't be able to claim IS.Be happy, it's the greatest wealth

No age limit- that only applies to claims under the lone parent category.0

Lone parents are expected to work once their child reaches a certain age - 7 I believe?

I must say that in all my years as a benefits advisor I never helped an income support claim in those circumstances but I did drop out of the game over 2 years ago now.
I would imagine that the families' prior income support on grounds of incapacity claim are under investigation at the moment so this may be the barrier to claiming income support?
Failing that it could be that the DWP do not accept that the move is temporary in light that the grandmother clearly isn't going to regain her mental state and her mobility when the grandfather dies? Is there a time limit on this type of income support?0 -
I'm not aware of a time limit as such but the regs around applicable amounts and household income/capital seem to point to an expected maximum absence of 52 weeks in order to be seen as 'temporary'. Entitlement is likely to stop from the point a longer period becomes likely.0
