Need Some 'Real' Help Here! [Denied IS, CA & Crisis Loan]

  • My father claims IS due to his heart condition and problems with asthma. He had to urgently go abroad (2 weeks ago?) to care for his parents and they seem to have cut all pay to his name. (which my mother was using around the home.) If I'm not mistaken, the rent gets paid separately but is also under my fathers name, so I'm assuming its been cut off. (there's no way to verify this atm.)

    You can't, your brother would have to do this unless you are an appointee for your brother. If your father is your brother's appointee then he would have to do this.

    I really am sick of replying to irrelevant replies... Really, you guys are of no help what so ever and love adding onto stress. Where.... OH WHERE did it mention that HE drove constantly, doing fast speeds in Germany? WHERE?

    Actually, no one ever knew anything about higher rate care up until recently when my mother was declined I.S. His situation has always been like this. Only now do we know that there was such a thing as higher rate care, if we knew before, we would have applied for it. [infact, back then we didn't even know there was such a thing as DLA until his care worker told us.]

    Yup, my father applied for it back in 2006, but that was the last time anyone ever mentioned anything regarding it. We never knew about mid or high rate DLA up untill recently. They declined the app for I.S because he is apparently receiving "low" DLA.
    As to refusal of the crisis loan, they don't normally refuse if people are waiting for the outcome of benefit claims, they can process an "alignment to benefit" and pay on those grounds until the claims are resolved. Perhaps they've refused because there's no benefit from which to recover the crisis loan ? Or do your parents owe any money to the Social Fund right now ?

    Nope, not that I'm aware of. They clearly stated it was due to the DLA anyways. The excuse for refusing the crisis loan was that she should ask friends or family for food/toiletries. [I thought it was a joke at first but no. Even though I clearly stated that they won't be able to support 3 people, on a daily basis.]
    Don't recognise this "stage one" thing you mention about your Brother. That term isn't an exclusion reason for Income Support, haven't a clue what it means. Think you might need to clarify that term with the Carer's Allowance people, book your Mum into the nearest Citizens Advice or Welfare Rights office to see if there's any guidance they can provide.

    Sorry, I couldn't think of what it was called when writing it. but again, its regarding the rate of his DLA.
    As to your Brother's health issues, you'll have to seek professional advice on that one. But from what you say your Mum can't sign on due to looking after him (she wouldn't be "available to work" if she looked after him full time) so JSA isn't an option, unless another family member or friend can look after him full time or at least share the burden with your Mum.
    Yup, that's what I figured. Regarding the looking after part, as I mentioned, she only has a brother here who doesn't live in London, and a few friends but have there own problems to attend to. (kids, jobs etc)

    I'll be applying for JSA tomorrow. Will see how it turns out, and I'll let you guys know.

    You apply for DLA in general and they decide which band to put you on. Sometimes they are wrong but as your brother has/had a care worker I assume he had help filling in the form and the care worker agreed with the award given (sounds like low care, low mobility), any good care worker would have advised that your brother/parents appeal if the award had been as out of whack as you are implying it is.

    When the compliance officer comes knocking (and under the circumstances it is highly likely that he will), he/she will ask much more indepth questions than the one you were asked earlier about your brother attacking your dad. Any discrepancies and the DLA claim can be called into question too, I hope your whole family aren't as defensive and inconsitent as you in those circumstances.

    Coincidence that you asked about insurance cover to drive to turkey before the need for dad to go.

    At least your mum and brothers can rely on your minimum wage job to keep the family warm and fed untill dad comes home.
    I mean, thats the very least you would do under such rare circumstances.

    Hello OP. I haven't read all these posts so I'm not sure if you have had a full/factual response. The issues involved are quite complex so although I can't answer off the top of my head I will look into the circumstances and pm you tomorrow- not least because I might need more info (if pms aren't facilitated by the site I'll post here.) I'm sorry to hear about your difficult circumstances.
