Your mum should get your brothers DLA award re-looked at if he needs so much care and is only on low level, that is more of a long term thing though as it can take several weeks for the award to be considered and she may need to appeal. It certainly isn't the fast route back onto income support so something has to be done in the meantime, does your brother claim ESA for being unable to work?0

Well if he's getting paid low rate DLA care your Mum won't qualify for Carer's Allowance, nor Income Support either. So the advice she's been given ... to claim Jobseeker's Allowance ... is entirely correct.
If your Brother's health has deteriorated since DLA was last considered, he needs to apply for his DLA entitlements to be reviewed urgently.
There's a vague possibility that Income Support could pay your Mum during the time it takes for his DLA to be reviewed, but they would have to be satisfied that your Mum is providing substantial care for him & she'll have to explain the nature of the care provided & it's duration. If satisfied, Income Support could pay without Carer's Allowance entitlement being determined and they'd pay without the Carer Premium addition. They might send a Compliance Officer to visit both of them to gather the evidence they need. But that's all assuming that the I.S. claims officer is aware of this little loophole ... Why not? My old man and his friend made it in just over 25 hours... And that was a first try attempt. It's only 1,600 miles away.

Not sure what type of 'save the trees' car your driving, buts its extremely do-able.
I only said 2 days for the sake of not having a co-driver, and wanting to "take it easy" travelling relaxed.
So it should be easy enough for him to pop back and collect the rest of his family.0 -

Thanks. I'll be sure to ask them over the phone tomorrow regarding his care award being re-looked at. I'm not sure if my brother receives ESA. I'll have to ask tomorrow in the morning.

I think that the DWP would find it very suspicious that the OPs brother suddenly developed substantial care needs (going from needing help for roughly 1 hour a day to needing constant supervision) just around the time that his father disappears and the family have lost their entitlement to means tested benefit as a result.
I think every hoop in the world would be hauled out for a request for a review of the DLA award in these circumstances - as it should be.0
