  • I'm waiting to hear back from the halifax, but ive noticed alot of you have received a call from them and not a letter, I'm hoping maybe they hav been trying to call me whilst ive been at work, dont suppose any of you know what number they use when they call or is it unavailable?
  • Sorry if i have missed this somewhere, but where do i post a letter threating the halifax with court amd giving them the 7days to reply.

    Halifax WON! Claimed £1549 on 8th Jan 2007, Settled for £1350 on 29th Jan, Paid 7th Feb.
    MBNA (Virgin / Alliance Credit Card charges): WON! Claimed £419 on 17 March, finally offered £425! on 5 June)
    Natwest Credit Card: WON! Claimed £250, got 100% + interest + court costs too.
    Northern Rock: Mortgage Discharge Fee: WON! Claimed £100. Offered £90 and accepted it.
    Natwest Bank / RBS: WON! Claimed £400. Got 100% + interest + court fees back.
    Halifax 2: Ongoing....

    check on the acknowledgement letter if u got one. u should have a reference number from your initial letter of claim. This thread has all the addresses and steps of the process u need. They wrote to me the day after I sent my letter before action (7 day letter). that got things moving for me. But you don't have to ring them. Just send your letter. Keep to the correct timetable. The ball is in their court. I made a deal as I wanted quick cash (got 87%). but if you can hold on for a bit longer as long as you have done everything properly, you will get it all back, plus interest once u have got to court stage. bear in mind, even if u want to 'deal' push them hard. u are in a strong position!

    Hi there,

    I'm new to all this, but have a steely resolve. Brilliant stories and advice, and ace to see people mobilising themselves and getting back what they deserve. A few questions:

    1. Does anyone have any experiences with trying to get charges back from credit cards (Halifax visa and capital one)
    2. Is there anything different about them?
    3. <this is a long shot> any chance on claiming on bank accounts that are now closed?!

    1) Am currently claiming back for an Intelligent Finance credit card (part of the HBOS group) and am away to send off a SAR to Capital One. Same rules apply. There's more about Capital One on the Consumer Action Group forums

    2) Nothing different although some try to claim that as a guideline was set at £12 they will only pay the difference between this and whatever they charged you. This is a favourite tactic of Barclaycard, insist on the full amount and they WILL pay.
    3) Yes, you can claim for closed accounts as long as the charges are within the 6 year period. Currently claiming for 2 closed Bank of Scotland accounts!

    Crikey, if I can claim for a closed account I am so after First Direct. They absolutely shafted me a couple of years back. When I eventually paid them back all their money I closed the account in disgust.

    LOL, go for it and good luck! Just follow Martin's guidelines and use the template letters and you will be fine. Keep us posted!

    Aw. Just thought of a problem - I no longer know my account number for my dead account. I think I probably burnt all the old statements in a purging ceremony!

    Reckon I can ask First Direct to look it up?

    They should still have all your details on file but they might try to claim it'll take longer to find them which is nonsense. Banks can find your details by postcode and name alone! Used to work for Bank of Scotland and that's what we did :D
