  • Hi,

I received statement pages 53-60 (of 60) from Halifax today. Are they obliged to send me the rest of the pages within the 40 days or does the fact that they've sent me some of the pages mean they have 'satisfied' my request (even though only partially).

    Thanks,

It's quite normal to receive your statements in batches. You can only complain if they don't send them all within 40 days.

  • I'm still waiting on my statements, they seem to be taking a long time to get here. I checked online though, and it shows I've been charged £260 in the last two months.

I'm past my overdraft limit and have bills due soon, I want to phone and ask them to waive some of the charges whilst I wait on the statements and claming the whole thing, but I have no idea who to phone or if I should go to the branch, and what I should say. Any ideas?

They must satisfy the request in full within the 40 days, unless there are exceptional circumstances why they cannot.
  • Stick to your own timetable. Banks will try to stall you in the hope that you'll give up. File the claim. To keep it within the small claims court either divide it up by time - say two years per claim or whatever, and remember to add interest! I'm in Scotland too but have a friend in England, so I use her address and do it all through MCOL, means I only have to submit one claim!

    Hi there money saving peeps,

I have been through all the standard letters to the halifax asking for my money back, and i have had a few replies from them, saying the usual nonsense they spout when they dont want to part with your money.

Anyway, the last communictaion i had with them was that they had until there 8 week deadline to repsond to complaints, which was the 15th jan. I have threatened legal action and now i feel that that this is my next action, going to court.

The court fees will cost me £120, now i dont mind paying that, obviously, but i dont want to proceed without knowing what happens, and what i look out for.

Not ever done this before i would love some advice before suing them.

    Cheers

    Brett

You have been very generous already with giving them time, so as you say it's now time to show them you're serious. Information about court is in the article here:

  • Hi Brett!

I agree with nicksmack, you've already given them plenty of time. Take time to read over the possible repercussions of taking it to court and familiaraise yourself with the process of filling in the claim. Halifax do the same thing as Bank of Scotland - they will wait till the 14th day to acknowledge your claim and will then either contact you to settle or let it go to the 28th day without contact. Either way, you win :D

    I cannot believe it.

    £1,674.00 paid up

Just rang Halifax and spoke to such a lovely lady . Mentioned that it's a lot of money to lose £548.00 and wasn't happy. Did also mention that if it went to court I wouldn't have to pay.

She didn't have to go away and speak to someone else and said OKay we'll pay the full amount.

    YES,YES,YES.:T

Money should be in our account by next friday. Oh my god, i feel like screaming with joy.
