    Im currently in the process of reclaiming bank charges of £1071.00 from the halifax bank. I sent them the first letter on the 7th Jan saying that i believe the charges are unlawful and that i want my money back. They replied with a letter saying they were sorry to hear i was unhappy and would look into it for me. Then yesterday they phoned me and said they believe their charges are lawful and as a goodwill gesture they are willing to offer me £270. Im not happy with this sum so am now looking to take it to the next step.

    so my question is, do i send them a letter warning them im about to take them to court, or do i go ahead and start court proceedings via the moneyclaim website?

    Sounds like you've lost track of your timetable a little. It's important not to let the bank sidetrack you.

    If you haven't sent the second letter (Letter before Action) send this now. Give them another 7 days to pay up in full, then commence the court claim on the expiry of this notice.

    Thanx for your replies.

    Since i posted the message this morning, Halifax have rung me again and offered me a settlement of £540 instead of the £270. I turned this down again saying that i believe the charges were unfair and unlawful and that i wanted the full amount and that if i take them to the small claims court i can also ask for 8% interest on top. The lady then put me on hold saying 'let me just see if i can get you the full amount', after about 2 seconds she was back saying that they could issue me a full refund of £1017!

    Hopefully in the next 10 days it will be credited to my account, after ive signed and sent back a letter they are sending me.

  • Hi everyone,

    I'm in the middle of claiming my bank charges of the last 18 months back from the Halifax which has come to £547 not including interest. I sent my first letter on the 14th Jan and got a reply on the 19th from my bank manager saying that she is forwarding the complaint. I just recieved a letter today saying that head office has declined my request for a refund of charges as 'they are seen as a fair reflection of the costs involved in the process of declining any unpaid items and any subsequent overdrawn situation which results'. Has anyone else had a response like this - I'm a little scared now!

    Morning all. Just a quick question if that's ok....
    I submitted my claim via the website MCOL on Friday. I now need to wait fourteen days to see if the bank respond I think. Anyway, is that 14 days or 14 working days ?

    Well Done! Hopefully you should have your money soon.

    Read the letter they send you to sign very carefully. Banks have included gagging clauses, notices they will close your account if you break the T&Cs again and various other restrictions.

    Some people have simply crossed out any clauses and returned the letter. This will result in either the bank conceding these points or they will withdraw the offer and you will need to go to court.

  • Had a phone call this morning, they first told me that they wouldn't be offering me anything as they believed the charges fair and just.

    I said I'd add on the interest and take them to court.

    They then made a low offer, I said not good enough and I'm still going to court.

    They then instantly offered me £1,000 (charges were £1,100) so I accepted that.

    Currently £42,000 in debt :eek: could no longer cope, contacted CCCS :A and now I'm working to sort everything out :D a long road......but worth it!!!
