    You claim for 10 lots of £39. Although £12 is the maximum a credit card company can charge. The OFT states this does not make it a fair charge. Only a court can decide this. The £12 charge has no relevence to any bank accounts. It applies only to credit cards.

  • I wrote to the Halifax at beginning of December requesting my bank statements for the last 6 years. I did not receive them within the 40 days and rang them but they could not tell me anything.I posted a recorded letter to them at beginning of last week giving them 7 days to forward me the requested statements. Yesterday I went to my local branch and spoke to bank manager he says he is dealing with the statement requests and does not recall getting a recorded letter. Today I checked the Royal Mail website and the letter has been delivered.Does anyone have any advice on what I should do now.

    Send a complaint to the Information Commissioner. Send copies af all your letters, and details of your phone call, include proof that the letters were delivered.

    We had this exact problem. Our statements eventually arrived after 45 days & numerous phone calls & 2 further letters. It's disheartening but be persistant. Try this number it worked for us: 0845 603 7923

  • I sent off my acceptance forms to Halifax accepting £1600 ( i have detailed my whole reclaim story earlier in this thread) on 12th Jan 2007, and after 9 of the 10 working days I was expecting to wait for payment to get in my account I gave then a call (25/1/07) just to chase things up, and they said they hadent even recieved my papers. DAMN it, I didnt use recorded delivery unfortunately, I just popped the pre-paid envelope in the post (silly i know), so whilst on the phone the man said I could fax it to them and then call again to check they'd recieved it in the morning which I did.
    So, I called them in the morning (26/1/07) and they confirmed that they had recieved the papers via fax now, although I would have to wait a further 7-10 working days now for payment.
    So, after already waiting 10 working days (2 weeks), I now have to wait another 10 working days (2 weeks) to get the money. This has really frustrated me now, as I only accepted £1600, which is £100 odd short of the full amount, and without £300 odd of interest as it was accepted pre-court, as I was hoping to get the cash quicker without dragging it through the court. So it turns out, I'd have probably been paid quicker if I'd have gone through the courts (and would have got more too!), whereas now I'll have been waiting nearly a month to recieve my reduced settlement :(

    This just serves as a warning: settling out of court, may not necesarilly mean you get a quicker payout, if thats what you are hoping for by following this path.
    REMINDER: Don't forget to make sure you send ALL you communications with the bank via recorded delivery, especially the acceptance papers.

    ... Very good point cache-man! I asked them to settle in full and pay me inside 7 days thus saving themselves £450+. They seem happy to keep our money for as long as they can. I wonder why??
    Halifax WON! Claimed £1549 on 8th Jan 2007, Settled for £1350 on 29th Jan, Paid 7th Feb.
    MBNA (Virgin / Alliance Credit Card charges): WON! Claimed £419 on 17 March, finally offered £425! on 5 June)
    Natwest Credit Card: WON! Claimed £250, got 100% + interest + court costs too.
    Northern Rock: Mortgage Discharge Fee: WON! Claimed £100. Offered £90 and accepted it.
    Natwest Bank / RBS: WON! Claimed £400. Got 100% + interest + court fees back.
    Halifax 2: Ongoing....

    Thanks :) Yep, We move in under 2 weeks now but the house is starting to fill up with boxes ready for everything to be packed up.
  • Can anybody please help me I need to send off my second letter to the Halifax tomorrow, I sent me first letter to my local branch and two days later I received a letter saying my letter had been forwarded to the customer relations dept to consider my request for a refund. What is the best address to send my next letter ?????. i must say i am now getting a bit worrys about starting the claim :confused::confused::confused:
