I Claimed back over £1500 in charges from the Halifax. Like you I rang and asked them for about £150 they had taken in 3 days. They almost (but not quite) told me to get stuffed.
I followed the link on here that Martin had given to the Consumer Action Group website and have not looked back.
I decided if I was going to do it I would go back 6 years and get those charges as well.
Halifax give in really easily once court papers have been served, an easy one to start with. One of the more difficult ones is Barclays they fight to the death sometimes settling the day before court.
I have had Mortgage charges back from Birmingham Midshires and will be sending them court papers for an Early Redemption Penalty shortly.
I have also had (unjust) defaults removed from my credit file in 9 days.
All I can say is go for it. The feeling of empowerment is wonderful. Good luck Lizzy0 -
misskitty wrote:Had a letter this morning from the halifax to confirm I rejected their offer yesterday of 1,223.00. And that it is their final offer. Have just called them to say I will accept the offer if they are willing to pay my court costs of 120 but they very nice man on the end of the phone said that as its now gone to court stage they will have to see the process through to the end.
I really hope I haven't just chucked 1,223.00 down the drain and come out of this process with nothing. I wish I’d have waited a bit longer until I started the court process instead of sticking to my strict 7 days after the 2nd letter was sent as they phoned to offer me the money the day after I’d started my claim. I’m really worried now
You've gone this far and AM sure you will have your full amount back.:A Tomorrow's just another day - keep smiling0 -

Thanks. Its quite worrying though. I may have turned down 1223.00 for being greedy and now go on to loose and not see a penny.
I also filed a claim against Capital One on the same day for about 150 (pound sign on my keyboard is broken:) ) and they have now said they are going to defend my claim.
Its all getting quite stressful now0 -

I got an offer of about 50% yesterday. I phoned them and said 'no'. The woman was abrupt and unhelpful. Though she did state that she accepted they may well have to pay me more at the end of the court process. Yet for some bizarre reason was absolutely not prepared to settle my claim in full and save the Halifax lots of interest plus £120 court fees too.
I think the reason for this is that the want to make us sweat, and be fearful until they finally pay out.
As long as we do everything correctly as laid out on this site we'll get our money back!! The Halifax will pay for me to go to Malaga very soon!!Halifax WON! Claimed £1549 on 8th Jan 2007, Settled for £1350 on 29th Jan, Paid 7th Feb.

Just wanted to add my story here, as it was the templates on this site that did it.
I wrote in December to my branch. Howver, when I rang because I hadn't heard back from them (and was a bit scared about doing the 'I will go to court' letter, it turns out they hadn't got it. I then sent on my letter to customer services in Leeds on the 23rd December. I allowed them 10 working days and they were prompt in their replies.
I asked for £1047+ £106 ish in interest. They offered us £955 and we decided to deal. Have to say the letter they make you sign is pretty offensive, making you accept all responsibilty but not them. but at the same time they're giving you the money so they must be bricking it really! They know they haven't a leg to stand on.
OK I could have gone to small claims for £95-200 more but I'm happy with my settlement and I didn't have the £130 and the inclination to do it TBH
I'm :-)
