    I think you should stick to it and get the whole lot back. Why let the bank keep some of your money unlawfully?

    I haven't accepted yet. I'm going to call her later and expalin that I won't be accepting and that I will continue with my court claim. the only thing I'm worried about is that according to Halifax I included a £30 charge on my schedule I sent which is incorect therefore my court laim is incorrect alsoas I asked for this charge back. Do I have to cancel the claim I have and start again with the correct amount thereore paying an extra £120 court cost?

    Read through the stories in the thread and it will give you an idea of the time scale with your bank.

    Keep your claim going. When you contact them, say you will be happy to settle for the charges+interest+court fee minus £30. Including one mistaken charge will not ruin your chances for the whole claim. If you get as far as seeing a judge, he can make judgement for all the fees minus this mistaken fee.

    Thank you so much for all your help! I wouln't have had the bottle to have gone through with this otherwise.

    Does anyone have the number for the halifax department that deals with these charge reclaims so I can give them a call now rather than waiting till i get home tonight.

    If they do indeed end up offering me the full amount could i make a donation to this site to help with the running etc/charity?
  • Hi, please be gentle-this is my first post, I have been a hoverer for a few weeks and feel overwealmed at all the help and support out there! My title says it all really, I would love to claim bank charges from the Halifax and have opened a new openplan account with the Woolwich as our DMP with the CCC is due to start next month but now I am nervous as our mortgage is with the Halifax and we are tied in until 2010. We took out the original mortgage in 2001 but my husband has been made redundant twice and now earns a lot less. Even with our combined income we would not get the same morgage or equivalent again so I am scared to rock the boat!
    Would the mortgage remain separate from all other dealings, we have never missed a payment, just owe masses on cards as we stupidly buried our heads in the sand and took a couple of years to get real to the new situation. We feel stupid and guilty as we have 3 young kids and are in the spiral of stress, sleepless and struggling!! Help please, sorry to moan!!!

    I would happily pay towards your alcohol fund :)

    Just called them up and said i am rejecting their offer and continuing with my moneyclaimonline as I want both the interest and court fee back. Hope this won't !!!!!! things up and they'll now issue a defence as they have been surprising nice up to now.

    Without going into too much detail..
    2 accounts....without interest £657 and £ 1401, total of £2058

    Telephoned them last week to ask what was happening as I was going to proceed to next stage....they apologised and said they had written but the letter had been sent to out previous address ( My hubby apparrently set up incorrectly....even though we get regular letters to our address now ?) so i was a bit cross at this....but the gentleman said he would amend.

    Anyway we agreed £1700 (without interest) over the phone to settle both accounts.

    Today I phoned to ask where the letter was and was told it had gone to previous address again ?
    I'm angry as it's a personal letter and said to the lady that my hubby was cross anyway for me accepting the lower amount and now the mess up of the address again he is not going to be impressed.
    She said...well if you want to decline the offer you can and persue the full claim..
    What would you do ?
    Am I being greedy ?

    Filed online at MCOL on Friday for £1734 (charges+interest+fee), was started on Monday.
    Just had a call from CS at Halifax offering to clear my overdraft (750) plus £25 as "good will gesture" (more like an insult!!!!!!) I refused then they said they will put an offer of acceptance in the post for £1000 (clear OD plus £250)

    Told them again thanks but no good, and that i have already put in a claim at small claims.

    Would I be best to see it through to the end at MCOL? or wait and see if they offer me more (my minimum amount i was going to accept was £1250)
