After letter before action was sent - i received an offer of £2030.

Phoned and told them this was unaaceptable and they then agreed to pay me the full amount of £3457 plus my court costs of £120 if i stop court action and of course i politely accepted.

    Hi there

I stupidly went overdrawn by about £24 yesterday and as soon as I logged on I noticed this. (It was a cheque that I THOUGHT had been banked by someone and they hadn't). Anyway, I transferred £100 from joint account to my account and money appeared in my account. So I must have been overdrawn by a couple of hours at the most. Letter received via e-mail to say blah, blah, blah £30 plus interest!!!! Can I get this money back as I personally think £30 is a bit excessive? I admit that I am in the wrong by going overdrawn but £30????!!!! Maybe the cost of the person writing the letter but they didn't even have to use a stamp to post the darn thing!!

    Thanks for your help!
 YES! I got my £30 back from the Halifax. After reading lots of these posts I just decided to phone them up and give my case for not being charged. Straight away as a 'good will gesture' they refunded my £30!! Woo hoo! :T Thanks everyone for all your help! :D

Hi my wife rang 08457203040 and asked for statments they came in about a week and they charged to my account £5 . why dont more people just do this its much faster.

The procedure in the article is set out to cover claimants as far as possible in the event the case goes to court. You can deviate if you wish, but you do run an increased risk of something going wrong. For some explanation on why the procedure is to write the request under the Data Protection Act, do a search on this forum for 'Manual Intervention'.
  • Hi,

I seem to be in a similar boat to most people on here - the halifax have been charging us everytime we've gone over the overdraft limit, (and according to our statements they have charged us on a few occasions when we didn't exceed the overdraft!).

After I received an email last week notifying me of £148 of charges (I accidently went £114 over the overdraft limit) I phoned the halifax and asked for a copy of all charges incurred since we opened the account in 2002. The very nice lady at the call centre told me that they didn't keep a record of charges incurred, but that she could send me statements for the time period mentioned and that this would incur a charge of £5. I accepted the charge and the statements arrived 3 days later. Our total charges are £1979, and with interest this adds up to £2165.18.

We opened the Halifax account at the same time as we moved our business account to the Bank of Scotland. Bank of Scotland has been excellent (mind you we've never been overdrawn in the company account). They did however pay £290 into the business account which didn't belong to us - I notified them immediately, but it took them almost 2 months to find out where it should have been paid. I wonder if the owner of that money charged them £28 plus £30 per item per day until they reimbursed him?

On several occasions I've been livid with the halifax because we've incured bank charges despite the fact I've made immediate transfers from the company account into the personal account inorder to avoid them. We've still been charged (despite the statement saying we haven't overdrawn) apparently because I've "made the transfer after 4.30pm". If the bank computers which print the statements say that the money has been paid into the account before any payments have left it, what right have they to still charge us?!

I can see by the statements how much the overdraft limit has been exceeded (or not), but without a list of charges it's difficult to see why I've been charged certain amounts. I know there are set charges of £28 (exceeding overdraft limit), £30(each transaction that exceeds limit) and one at £39 (returned D/D?). Yet I cannot understand how I've received a charge of £108 on one day - my maths isn't brilliant, but I cannot make an equation using the above numbers to equal £108, I also had a charge of £50, and I can't work out where that figure comes from either.

Has anyone been successful in getting an actual list of charges rather than just statements? I have ploughed through the previous 38 pages of this thread, but I've not been able to find an answer to this, so apologies if I've missed it and it's already been mentioned.

I plan on writing a preliminary letter this evening based on the examples given. Having read everyones' experiences so far, I've decided to ask for interest too and then use it as a bargaining point. Wish me luck!

  • I'm about to embark on my claim...
Will the Halifax close down my current account once I start the claim? I'm just wondering whether I should open an account with another company first??

    Good luck everyone :)

Maybe, so make plans in case this happens.

    Hi guys

After reading this website, I decided to give it a go and try and reclaim my bank charges, I downloaded the standard letter, amended it and sent it away - I got a letter from the bank yesterday (Halifax) saying "blah blah blah but as a good will gesture we are refunding all of your charges" - thats £249! so to say I am a bit happy is an understatement! :j

I have been fairly good and dont spend money I dont have, most of the charges were accrued when I would transfer money from one account to another to cover a direct debit that was going out, sometimes it would take 3 days for the money to go across even though the accounts were with the same bank so I consider the charges really unfair so I am very pleased I am now getting them back!!

My question to the more knowledgeable people on this board is; now that I am a bank charge reclaiming expert, I am trying to get my mum and dad to reclaim theirs too, however, they owe quite a bit of debt to their banks and creditors and are set-up with reduced payments, if they try and reclaim their bank charges would the bank etc start getting funny with them and demanding more money and not accepting their reduced payments?

I am trying to convince them that they should try and reclaim them anyway as the amount they would get back in unfair charges would go a long way towards reducing their overall debt. One bank I think it was alone charged them £1,000 even though they were paying them back as much as they could afford.

Also, a question for me; now that I have reclaimed my bank charges, the letter says that if I receive anymore charges they will close the account, has anyone had experience of this happening?

    Thanks guys!

    Terry

You wouldn't be the first, unsuprisingly the banks don't always react kindly to being taken to court by their customers and sometimes retaliate. Hopefully you won't incur any more charges, but if you do, be prepared to move!
