halifax bank charges (merged)

Have finally received all my bank statements this morning!!
I actually sent the information request back in mid-December, and was getting quite miffed because Halifax keep calling me about the £500+ overdraft "I owe them". Nasty call from Retail Bank Collections that got so bad I just had to put the phone down! I speak as a former member of HBOS staff with years of service.
Worked out the charges on two current accounts works out at a total of £678.00. I am also going to include £40.00 of charges on my personal loan account as a result of them messing up the current account.
Looking back I had run my account really well over the past six years, until recently, but problems with my new employer resulted in being on the wrong tax code and failed BACS transfers (three months in a row!!). It all snowballed from just one or two direct debit charges (mortgage and car, etc.).
Am just about to send the second letter back asking for the charges back, but giving them just 7 days to respond, considering I've had to wait nearly a month just to get information out of them!
Sad thing is that once I get the charges back, they are only going to pay the Halifax back in arrears on my personal loan!

Hi All
Just a quick question : Up till now on both the prelim and the LBA letters i've sent, I've only listed charges for unauthorsied OD, unpaid DD's etc.
Is it possible to claim for the interest caused by going overdrawn, these charges usually are around £5 or so each month.
If it is possible to claim for these charges, am I to late? Or can I add them on to the mcol, which I file early next week?
Cheers

Write to the bank, say something like...............
I cannot accept your offer of £1000 as full and final settlement of my claim. I would accept this as part payment and without prejudice, but I will continue my claim for the balance. How many surrealists does it take to change a lightbulb?

If the bank made a mistake with your account that led to the charge on your loan. This should really be dealt with through the banks complaints procedure.
I would be more careful of claiming charges from the loan. If you have incured charges through late payments etc. They may decide to call in the loan. How many surrealists does it take to change a lightbulb?

is that something i could do then? i've told them i wouldn't be accepting their offer but they send me a form in the pot just in case i deicde to change my mind. could i send it back saying i would accpt it a part payment? how would this effect the existing moneyclaim i have for the full amount. would i have to cancel it and start again for the remainder?0 -

Your situation is just a little bit different. They have offered the full amount, but only after your deadline, and after you issued a court claim. I wouldn't return their form. I would write saying the same as andy_H, but adding that you made a reasonable effort to settle this without going to court. Say that you gave them a reasonable amount of time to settle, but they ignored this so you issued your court claim as you had informed them you would if they didn't respond in a reasonable time. Seeing as you have now issued your claim, you now require charges+interest (per s69 County Courts Act)+court fee, as you are confident that the judge will rule in your favour regarding your claim. How many surrealists does it take to change a lightbulb?
