    I have received a reply from my first letter sent to my local branch from a named customer advisor stating they won't refund any of the seventy four charges on my account because I had two refunded last year and two this year. I am now drafting the second letter to send.
    Should this second letter go straight back to the named advisor or to somewhere else, also which county court name do I put in the letter if I use the online money claim service and which Halifax address would I put onto the online claim form

    Send the letter back to the address on the letter they sent you. See post #6 in THIS THREAD to find your local county court (this is the one you put in the letter).

  • Cheers Rex for replying so fast I can now get this second letter sent to them tomorrow.
    I will keep everyone posted about the outcome!
  • This is what's happened with my claim so far:
    22/12/06 - Requested statements for last 6 years.
    6/1/07 - Postman knocked, with banded bunch of letters. 45 in total. 223 sheets of statements! Spent weekend reading them with great interest!
    8/1/07 - handed claim in at local branch for over £1500. Given bank 2 weeks to respond. Staff were very friendly and helpful.
    9/1/07 - letter received with usual... thanks for your complaint.. we'll look into and get in in no more than 4 weeks.
    11/1/07 - another leter from Customer relations in Leeds saying the same giving me a ref no. and their Tel No. 08457 25 35 19.
    23/1/07 - no reply received. i therefore rang the tel no given and advised them next letter to be sent if no full settlement. and possible court action to follow. they would not discuss due to 'backlog' of letters.
    23/1/07 - i sent letter before action by Recorded Delivery to Leeds giving them 7 days to settle in full before court procedings.
    26/1/07 - Letter recieved from Halifax Cust Rels (in Newcastle) offering me £820 as full & final settlement. I rang them to decline and asked for full settlement. They asked if I would negotiate and if I felt I should pay 'some charges'!!! They would not be changing their policy and if I didn't like it I should go elsewhere. I stuck to my guns. They said 'then take court action'. They will not settle in full now even though it will cost them more. I.e. £350 interest and £120 costs.
    29/1/07 - Sending letter by Recorded Delivery. As per advice to 'keep things in written form'. Confirming I am declining partial offer and as per Friday's conversation where they made it totally clear that 'there would be no further correspondence from them on this matter', I will instigate action via MCOL this week (Wed). They could pay up in full now - £1500 - inside my timeframe, or if not, then it'll cost em nearly £2000.

    They have got personal here. But I AM NOT SCARED OF THEM!!!!!!
    Halifax WON! Claimed £1549 on 8th Jan 2007, Settled for £1350 on 29th Jan, Paid 7th Feb.
    MBNA (Virgin / Alliance Credit Card charges): WON! Claimed £419 on 17 March, finally offered £425! on 5 June)
    Natwest Credit Card: WON! Claimed £250, got 100% + interest + court costs too.
    Northern Rock: Mortgage Discharge Fee: WON! Claimed £100. Offered £90 and accepted it.
    Natwest Bank / RBS: WON! Claimed £400. Got 100% + interest + court fees back.
    Halifax 2: Ongoing....

    I'd be interested to see what defence they enter against you. I'm wondering if they will use this call against you (saying you wouldn't accept a negotiated amount).

    thanks for this Rex_Mundi. Does this weaken my case at all? I had tried to negotiate before sending off my 7 day letter but they refused. Once I had issued the letter, I was of the view that I should not acept anything less than full settlement. Your view would be welcome. Thanks in advance.

    LOAD OF RUBBISH

    I have had so many £30.00 "goodwill gestures" over the last 2 years I still have my claim back last week to the value of £1,674.00.

    The Halifax had offered me £820 on Friday after I originally claimed £1549. I declined this offer and as the conversation went badly was ready to go to court. The person I spoke to was abrupt and uncooperative even though I was polite.

    However, after speaking with a very helpful bloke in Newcastle this morning, I have agreed to accept £1350.00. (87%) I have done this on the basis that if I am honest I have not run my finances as well as I wished I had and that I need the money quickly. This is a lot of money to me now as I have started up a business.

    I could have seen it out to the end and gone through MCOL, but was satisfied that £1350.00 was fair when all is said and done.

    Of course I need to sign papers and wait a week or so for the money to be paid to me, but I feel great now and thanks to Rex_Mundi and Edinburghlass for the crucial advice on here. You make a difference to peoples lives! ;)
