halifax bank charges (merged)

That's a sticky one - you could argue that the first letter you sent (the SAR) was the beginning of your claim and it's only their delay that caused your initial claim to be lodged in 2007 and not 2006. Any help, mods?"Think for yourselves and allow others the privilege to do so too." Voltaire.0

Just sent a letter today by recoreded mail, giving them 7days to refund my charges. do i need to write to them after the 7 days if i dont get a reply or do i just proceed with the court action??0

Just proceed with the court action. It says in the letter that you will proceed after the 7 days so just do it! Good luck!"Think for yourselves and allow others the privilege to do so too." Voltaire.0

I sent my inital letter requesting statements on 22nd november 06, they took almost the full 40 days to send the statements, I sent the inital letter with the schedule of charges a couple of weeks ago, and I'm just about to send the next letter threatening court action in 7 days. Someone from the Halifax called my partner yesterday and said that we were claiming for a period over the 6 years because the charges date back to November 2000. We've tried to argue that we've claimed for 6 years from the date we made them aware of our intention to claim but they're not having it. Apparently we can only go back 6 years from today! (so basically if they drag it out by a few months we'll lose money because most of the charges were from around 6 years ago!)
Is this correct? I would have thought that I could claim back charges 6 years from the date I told them I would claim.
You would only be able to claim back from November 2001.0 -

I am wondering whether, when the 14 days is up, it might be worth me giving them a ring before I file court papers to see if they are prepared to discuss a settlement.....
Has anyone else done this successfully and if so, what is the best number to call? I sent my letter to Trinity Road.
My claim is for £7789 (plus interest) so this would REALLY come in handy at the moment.
Thanks
I did a deal over the phone before court action was due. I got nearly all of what I claimed. I needed the cash quickly. Plus I didn't want the hassle of court. The banks know we need the dosh. In many cases what we are claiming is almost life changing money. I was happy that I did what I did, when I did it. What better way to start my week, than at 9.30am Monday knowing that £1350 that I never knew I had (until recently) was coming my way.
It's your money at stake. And a lot too!! If you do end up speaking with them, remember that you are in a very good position. You have them bang to rights. They know it! On all known evidence so far, if u do everything by the book, and stick rigidly to your timetable, you should get the lot back plus interest once you have taken court proceedings. Track back on this thread, and look at all the success stories too. There are loads.... and loads...!!!!

Further to my previous post, someone gave me a phone number which I called and they said they had not received any of my letters, even though the first was acknowledged and the 3rd was sent by recorded delivery. They gave me a fax number and I have now faxed it through. Wonder if this is stalling tactics due to the size of my claim. Unsure how to proceed now???0

Can I ask do you write asking for your statements to your own branch or is there a central office that deals with this? I am a halifax customer. And do they traditionally close the accounts when paying up? Thanks, Debs.0
