bizarre, having successfully claimed charges on my joint account, i had a charge over christmas for 39 pound on my own account - first and only in 16 years!, so i butchered the CAG letter to write and say its unlawful etc etc, got the usual 'terms and conditions, all your fault etc etc' letter, but as a gesture of goodwill they will give me £141 !!!!!
£141!!! i was only asking for 39!!!
Yes i have sent off the acceptance form!!! ha ha!!
will let you know if they actually pay it!!

Please don't say I'm wrong again? We spent about an hour arguing when I sent the original claim off because I thought I had to go back to 1999! It was bad enough having to back down on that one and admit I was wrong but I can't be wrong again!0 -

hi Dok. I was in the same situation as you and i took halifax to court on 21st of Jan. they have till the 10th of Jan to respondso im sat with my legs and arms crossed. will keep you all informed. dont back down , go for it!!dok wrote:Hi there money saving peeps,

Anyway, the last communictaion i had with them was that they had until there 8 week deadline to repsond to complaints, which was the 15th jan. I have threatened legal action and now i feel that that this is my next action, going to court.
The court fees will cost me £120, now i dont mind paying that, obviously, but i dont want to proceed without knowing what happens, and what i look out for.
Not ever done this before i would love some advice before suing them.

posted first letter and received reply couple of days ago saying "blah blah blah respond withing 4 weeks blah blah blah"
As advised I am sticking to my own timetable, and after their initial 14 days are up I'm giving them 7 days notice before i start the court ball rolling.
BUT, I am prepared to take a sensible offer to avoid the time and hassle involved in going to court. A bird in the hand and all that.
Now, the total (inc interest which i calculated) is in the region of £700 , and the actual charges are around £500.
If they offer me the exact amount claimed (ex interest) am I obliged to accept?
Is it worth making a 'without prejudice' offer for around £500 and seeing what they say?
I noticed the letter came from Leeds, but am I right in sticking to sending letters to the Halifax address?

Any offer the bank might make won't include the interest as they are only obliged to pay this if it goes to court so if you were to receive an offer of £500 you would be doing well.0

I finally recieved my statements in the post. I just finished adding them up and it comes to £1,093.50 plus interest.
I've recently had some cheques paid which took me over the limit again though - I've not been charged yet, but I'm sure I will be. Should I wait for these to be charged, or can I add the charges onto the second letter? Or is there something I can say in my first letter to acknowledge these and ask for the money from them as well?0 -
I have just sent my request for my list of charges/statements to the halifax, however i've sent them to the branch where they were opened. Do you think this will be ok?
