scabbers wrote:Good Morning. I've just had reply to the 2nd letter I sent to Halifax plc (the one asking for my money back). It says they're sorry blah blah and that "a Customer Relations Manager will investigate the points you have raised and you will receive a reply shortly, but certainly no later than 4 weeks"
Shall I just send off the next letter saying I intend taking them to court or should I wait for them to contact me? The amount I'm claiming is £500 inc. interest.
I stuck to my guns and sent the 3rd letter yesterday which outlines court and the interest charges. ALthough I have had an offer I am waiting until the end of today ( about 4.00pm ) to make a decision. Also getting some advice from this site.
Up to you but am sure some really good experts will be along shortly.:A Tomorrow's just another day - keep smiling0 -

.......Just had an offer through this morning post from halifax. They are offering £1,126.00 as a "Gesture of goodwill" . If I accept will be in our account within 7 - 10 days. Anyway I have asked for £1,674.00 + the interest of £292.53 which I sent in yesterdays 3rd letter to them. They would have received this paperwork first thing.
So, what do I do ??? ...........
Soooooo unsure what to do.....

skintscouser wrote:hi raq. i am in the same situation as you. at this stage, i.e. where we have sent them the 7 day letter warning them of court action, we should not settle for any less then the full amount they owe. Rex Mundi advised this on this thread last week to a few people. If it gets to court we get our interest on top too!
Thanks for the quick response.
Shall I call them and say I am not accepting anything less than £1,600.00 and take it from there.:A Tomorrow's just another day - keep smiling0 -
Hi all,
I sent the 14 day letter to halifax 12 days ago and have had no response. I telephoned and spoke to customer relations today who claimed they had not recieved the letter. Do I have to send it again or should I just register with money claim in 2 days? The problem is, should it go to court, I cannot prove the letter was sent so if I am to resend it i guess I will probably be best using recorded delivery. Any help, much appreciated. Thanks.0 -
Raq. Yes, that's what I would do. Your 7 day letter spells that out to the bank, so they know what you want. They are trying to buy you off on the cheap.
To help you with your decision this was Rex_Mundi's advice in a post he made on 19/1/07 -
''Keep to your timetable throughout your claim. Once the first 14 day deadline is up. Post the next letter. If they don't reply with a full offer to settle within your next deadline. Issue your court claim. ''Halifax WON! Claimed £1549 on 8th Jan 2007, Settled for £1350 on 29th Jan, Paid 7th Feb.

So, what do I do ??? Do I accept or fight all the way. There is a difference of £548.00 which I can really do with paying some major bills. Just spoke to my husband and he said wait until late today then give them a call.
Soooooo unsure what to do.
Any help Rex Mundi and Misskitty or anyway else who has been in this situation.
Well done you! I still haven't heard anything yet so I put in my court claim yesterday. Maybe that will spur them on0 -
