    Just send the next letter anyway. This gives the bank 7 days to respond. During this 7 days, phone your local county court and ask them if you qualify for an exemption from fees. If you do, you need to issue your court claim in person at your local county court (you can't get exemptions online). The court will tell you what proof they need to see when you issue the claim (to get the exemption), and you will need three copies of the form N1 to make your claim (get a spare in case you make a mistake on one).

  • It's now 42 days since asked for statements. Received 2004-2006 approx. 12 days ago & then on Saturday we received duplicate 2004-2006 statements & still nothing else. Have spoke to Halifax a moment ago & she said will re-order them!!!
    Should I be complaining to someone? So, dis-heartened at such an early stage.....it's like pulling teeth!
  • You can complain but as they have said they will re-order its not going to get them to you any quicker. Give the bank a few days and if you don't have them then phone again.

    Send THIS LETTER ASAP. Change it a little to fit your circumstance.

    Can I just clarify. I have about £1000 balance left on Halifax credit card. Would it be better to claim on the current account first. Because I am worried they will ask me to cough up for that £1000 straightaway if I claim on the credit account as well. At least if I get something from the current account first, I will then at least have something to pay towards paying the credit account balance off with.

    Thank you again - just want to make sure I do everything the correct way.

    Just rang the courts and this is correct. Got all my documents and will be popping in next week. As you did mention though I will send the one above + the interest.

    Just actioned my 3rd letter with all the interest on them. Husband just on his way out to the post office.

    Sorry to bump this, I know everyone is busy and I appreciate any advice given. Just didn't want it getting left behind and I am itching to make that 1st call to get my statements back.

    hi there Raq. i am in the same boat. sending 7 day letter tomorrow. told halifax they could settle in full or pay up nearly £2000 when i take em to court. natwest and all credit cards on the go too. push em all the way and make em pay mate ;) good luck!
    Halifax WON! Claimed £1549 on 8th Jan 2007, Settled for £1350 on 29th Jan, Paid 7th Feb.
    MBNA (Virgin / Alliance Credit Card charges): WON! Claimed £419 on 17 March, finally offered £425! on 5 June)
    Natwest Credit Card: WON! Claimed £250, got 100% + interest + court costs too.
    Northern Rock: Mortgage Discharge Fee: WON! Claimed £100. Offered £90 and accepted it.
    Natwest Bank / RBS: WON! Claimed £400. Got 100% + interest + court fees back.
    Halifax 2: Ongoing....
  • I'm so excited......rang halifax today after waiting and waiting for another week......spoke to a really nice guy who looked at my account and said that a letter had been sent out to me offering 3600 just over half of what i asked for i said no way and that he had to be a lot closer to 6000.....he asked me to hold on and he would see what he could do....came back and offered 5500....i said would ring back and let him now what i decided.......started jumping up and down in my living room rang other half and both decided that we would accept........no court papers were issued and im just so chuffed ......so thanks to everyone who spurred me to keep going. wish i could take you out for a drink but cant but i will certainly toast a toast to you all tonight.....just gotta wait for money now.....:money: :T
