  • Hi everyone great advice and i have started my claim, but i have a small problem

    my stack of statements arrived yesterday all neatly banded together and I worked out the charges to a little over £600 and sent of my first letter.

    anyway this morning another envelope arrives containing a few more pages form the statements this had 12 more charges! (a bit suspect that this was seperate)

    can i just send another letter asking them to disregard the first or hope the turn down the first and i just update my second letter to include the £900 claim?

    thanks in advance and i cant wait :) this money will really sort me out :)

    I had a similar problem, I waited a few weeks and eventually Halifax told ME what the total charges were and included a sheet of all the charges, they then told me that I could accept half of this, which i declined, then they responded saying they would pay the full ammount. It pays to be patient.

    thanks for the feedback, so do you think i should just leave it for now? and see what they say or send another letter with the correct amount?

    Im just worried that they will only refund the first amount :(

    I sent leter threatening court action just over week ago.........still heard nothing should i ring them and see what they say or start thinking abt court papers or issue them another letter giving them another week to respond......there really dragging there feet......

    Hi I am in the same boat as yourself I sent my last letter threatening court action on 4th Jan. However I received a phone call in work today but I could not take it from the Halifax, Im unsure as to what they wanted but I think it must be about this. Im ready for them tomorrow.

    -- I'm not an expert, but have read loads on here... so hope this helps.

    Once the notice you have given them is up, file your claim with the court on Moneyclaim on that day. Stick to your timetable. However, it is worth ringing them just before to let them know this is their absolute last chance to settle, and for some people on here that has worked and the bank has settled at the last min - in several cases in full. good luck! and let us all know how it goes.

    MBNA (Virgin / Alliance Credit Card charges): WON! Claimed £419 on 17 March, finally offered £425! on 5 June)
    Natwest Credit Card: WON! Claimed £250, got 100% + interest + court costs too.
    Northern Rock: Mortgage Discharge Fee: WON! Claimed £100. Offered £90 and accepted it.
    Natwest Bank / RBS: WON! Claimed £400. Got 100% + interest + court fees back.
    Halifax 2: Ongoing....
  • Also, you prob already know this but just in case, use the interest as a bargaining chip. If the bank settles in full or near to that before court action, they save themselves all that interest and costs too. Use this argument. It's worked for many.

    It's like the psychological mind games between The Banker and contestant on 'Deal Or No Deal'. If the price is right for you, then you deal. But if you go on, you may well get the lot, but as we have all been warned there is an element of risk, albeit very small.

    I've read on the court website that if you don't attempt to settle via alternative means (e.g. ombudsman) then you might not get your court charges back? Is this true? Working Lunch TV programme showed people suceeding in getting bank charges back via the ombudsman. Which is best/easiest, court or ombudsman? Help!!!

    Thought this would be simpler. Just want MY money back - NOW!
    Think I am about to get the same run around from Alliance & Leicester (waiting on a call back, hmmmm within 3 hours apparently.....)

    Hi. I'm not one of the resident experts but hope this helps. Have another read through the advice on MSE's Reclaim Bank Charges Guide

    and you 'll see they are just 'playing the game'. The idea is that many people will be put off claiming. Those who give up effectively pay for those who pursue their claims. This is how the banks are limiting their 'damage'.

    Don't be put off or be 'paranoid'. Push ahead as per the procedure outlined on here. Ringing Customer Relations and trying to get a settlement negotiated over the phone has worked for many. Just be polite and professional with them. Have them know that you know your rights.. If if doesnt work, press ahead through the court / Moneyclaim. Good luck.

    25th 5th 05 for the 5th time in the 50th final we are the 5th to keep it. Revenge of the 5ith.
