  • Hey Guys, this is my first post, I’ve been a big fan of this site for a long time.
    After lots of pondering and sleepless night, I have started proceeding against the Halifax bank for £715 worth of bank charges.
    I downloaded the template letters and send the first one recorded deliver on the 15th Jan and I received a letter this morning from the manger of my local branch saying she had passed my letter to the customer relations department to see if I could be conceded for refund.
    I will keep this post up to date and let you all no the out come. I would be great to here from other people who are taken the Halifax on to.

Why me? Off to court we go.

      You should send all letters recorded delivery.

      Details :

      24/11/06 1st letter sent to Halifax with breakdown of charges. They replied advising charges are part of t&c.

      11/12/06 2nd letter sent to Halifax giving seven days for full response before court action. They replied advising the matter would be passed to their Customer Relations Dept. As I considered their letter not to be a full response as requested in my letter I began court action.

      28/12/06 entered claim online; dated documents served to Halifax 3/1/07.

      Halifax acknowledged claim and had until 31/1/07 to reply/defend.

      17/1/07 checked bank account and two credits appear today; one for full charges and another for interest plus costs, just over £2000.00 No letter received yet.

      it can be done; don't be scared of the court process. the banks have gotten away with overcharging for too long.

      the entire process has taken 55 days; just under 6 weeks.

      Nice one mate! For those of us on here who are having problems with the Halifax, this post is a reminder that if we hold our nerve, we can win! Some have suceeded via haggle and negotiation but it seems more of us are having to 'work' to get our money back.

      Everyone should ensure they have thoroughly read the MSE guide **click here** , and that we know from the moment we write that 1st letter, we could end up taking the bank to court **click here** to see how Moneyclaim works.

      The banks know they can't lose by testing our nerves as the money we are claiming back means much more to us as individuals than it does to banks that have billions! This is the game they are playing. It means they only pay back millions, instead of the billions they have over-charged!!!

      Halifax WON! Claimed £1549 on 8th Jan 2007, Settled for £1350 on 29th Jan, Paid 7th Feb.
      MBNA (Virgin / Alliance Credit Card charges): WON! Claimed £419 on 17 March, finally offered £425! on 5 June)
      Natwest Credit Card: WON! Claimed £250, got 100% + interest + court costs too.
      Northern Rock: Mortgage Discharge Fee: WON! Claimed £100. Offered £90 and accepted it.
      Natwest Bank / RBS: WON! Claimed £400. Got 100% + interest + court fees back.
      Halifax 2: Ongoing....

      Just like to carry out a quick straw poll if you don't mind.

      I made a claim to Halifax for £737 + interest (£281.57) grand total of £1018.57.

      Today recieved a first offer of £532, following my initial letter, approx £200 shy of the actual claim amount. As its so close to the claim amount (I thought the interest was always a gamble) I'm tempted to deal, what would you guys do?!?

      Deal, or no Deal?

      Bigbird, they are clearly dragging their feet. Have you had a written acknowledgement from Customer relations or Halifax Head Office? If so give them a ring. I got a letter from C/Rels - tel 08457 253519. They gave a ref no. to quote if I needed to speak with them. Not sure what you've had but if they mess you about any more it sounds like it's time to move on to court action / Moneyclaim. . keep us all posted on how it goes. Good luck!


      Hi skintscouser thanks for advise rang them today and they tried to tell me that they had until the 29th of the month to reply and that they look at all claims in date order. I said that we were working on my timescale and not theirs and they simply replied that they were working on the financial regulations time scale and that they were in there rights to take this long!!! the cocky gits..... andyway told them that i would give them a further week to reply and if not i would proceed to court.

      Just noticed tho that i might have cocked up and put three charges in that were prior to the six years should i resend my letter without these charges on.....what a divvy
