DEFINITE RESULT
Just phoned Halifax and said thanks for their offer, but before I am able to accept I need them to address 2 issues. Firstly I need them to increase the offer to £920 to cover my court fees and secondly I need them to agree to paying the funds into my account within 3 working days, not 7-10 as indicated on the offer acceptance form. He put me on hold for about a minute and came back saying no problem, they would fax me a revised acceptence form. I well pleased with that.
Anybody know how I go about cancelling the court proceedings?0 -

You've been had by the bank!!! The six month thing may well be their internal policy, but it has no meaning in law. If you had carried on your case, you will likely have got all your money back.
The problem is that you've signed to say that you've accepted their offer in full and final settlement. You will have a very hard time now just because you've changed your mind. If you pressed for the rest of the money, the claim would likely go to court. The bank have got it in writing that they made a goodwill gesture of £4500 as full and final settlement, and you signed this to accept. If you argue about the six month thing, if they could show that this is their banks policy on refunds. You would stand a good chance of losing your claim in court.How many surrealists does it take to change a lightbulb?

I claimed £200 of charges from Halifax with £103.54 of interest on top! The Halifax refused to pay out any of the charges which dated back to 2001/04. I went through the Moneyclaim process at the beginning of January, I got notice of acknowledgement from the court last week and this morning the charges and all the interest have been paid into my account! I'm amazed and thrilled!
Thanks to everyone on here for all their help and support ~ I couldn't have done it with out you

Hi All,
My missus is getting nailed by the halifax every week to the stage that now her wages are just covering the charges incurred frm the week before (she works part time). We're now stuck in a cycle of charges as each week her wages clear the overdraft, but then the charges incurred knock it out of kilter again!
halifax have been quite rude to my wife over the phone and seem to be taking advantage of the fact that English is not her first language.
Any advice? Do you think they would listen to me if I spoke to them on her behalf?0 -

I'd read some of the forums/articles on here about reclaiming your charges and get the ball rolling asap.
Hopefully if you get a lump sum into your account as settlement, you could stop the vicious cycle once and for all.0 -
I am claiming £1358 bank charges from halifax, got statements then sent 1st letter giving 14 days notice on 29th december, recieved letter off local bank saying it has been forwarded to head office, nothing heard of so on 11th jan sent letter giving 7 days or court action.... still nothing except a call on 12th saying they had recieved letter and are looking into it.
Just checked my balance , still overdrawnno payment recieved
What now?
Fill in claim form today at moneyclaim or make quick call on above number some one posted?

Right, need some advice.
Today, 8 days since sending my Prelim Letter, Halifax sent me a standard reply letter stating they wont refund any charges because they are in their T&C.
Should I still stick to the timeframe and wait another 6 days before sending the LBA letter, or as I have received a reply from Halifax, should I now send the LBA letter?0
