Bigbird, they are clearly dragging their feet. Have you had a written acknowledgement from Customer relations or Halifax Head Office? If so give them a ring. I got a letter from C/Rels - tel 08457 253519. They gave a ref no. to quote if I needed to speak with them. Not sure what you've had but if they mess you about any more it sounds like it's time to move on to court action / Moneyclaim. . keep us all posted on how it goes. Good luck!Halifax WON! Northern Rock: Mortgage Discharge Fee: WON! Claimed £100. Offered £90 and accepted it.

sent them my letter yesterday threatening court action so i might wait until friday and give them a ring to see what they have to say. I’m hoping the letter will do the trick without me having to go down the money claim route as that’ll cost me money I don’t have at the moment. If I don’t hear from them/they don’t make me an offer i'll be claiming on moneyclaim first thing on tuesday morning when their 7 days are up (if my replacement credit card arrives in time for me to use to pay with as i lost it last week)
have you heard from them at all other than to say the customer relations department had received your first letter?
I’m really hoping they'll pay up as the money would enable me to pay off my two credit cards with horrendously high interest rates which I’m really starting to struggle with pay off as I’m due to move house in a few weeks, but knowing my luck and my past experiences with them and me being so bad at managing my account in the past I’ll be the unlucky one with whom they’ll defend the claim and I’ll loose. I really hope not!0 -

Feeling negative now but just incase I need this ready for Monday what is the MONEYCLAIM.
Also I have just been accepted for JSA contributions, will I have to pay the fee or will I have to fill a book load for the application..??:A Tomorrow's just another day - keep smiling0 -
Can anyone give me a pointer please?
I moved house in October so we now have no savings and work owes me £1200 of expenses but I've been waiting 6 weeks to be paid them so I'm in my overdraft. I'm not gone over the agreed limit (I'm not even half way at the minute) but I've received 1, or possibly 2 charges for the overdraft, around £15.
Can I claim this back? Do I use Martin's letter? What else do I need to know? I'm with the Halifax.

Moneyclaim is the online court service you use. I've copied the below from one of the stickies at the top of this forum:
"Cost of going to court.
Use the Moneyclaim website in England and Wales (there's also the Northern Ireland Courts online) which can be used for starting most county court money claims, just go there and fill in the form. There’s a fee of between £30 and £120, depending on the size of your claim, which can be paid by a credit or debit card; though it’s refunded if, and hopefully when, you win. If you don’t have plastic to pay on, get the paperwork to start the claim from your local county court and pay there; it’s the same price. This may be waived if you’re on benefits.

Amount Claimed : Charges 1796.00, plus interest, plus legal costs £120.00
Amount Paid : £1976.00 & £233.48 :T
Details :
24/11/06 1st letter sent to Halifax with breakdown of charges. They replied advising charges are part of t&c.
11/12/06 2nd letter sent to Halifax giving seven days for full response before court action. They replied advising the matter would be passed to their Customer Relations Dept. As I considered their letter not to be a full response as requested in my letter I began court action.
28/12/06 entered claim online; dated documents served to Halifax 3/1/07.
Halifax acknowledged claim and had until 31/1/07 to reply/defend.
17/1/07 checked bank account and two credits appear today; one for full charges and another for interest plus costs, just over £2000.00 No letter received yet.
it can be done; don't be scared of the court process. the banks have gotten away with overcharging for too long.
the entire process has taken 55 days; just under 6 weeks.
