Amount Claimed : Charges 1796.00, plus interest, plus legal costs £120.00
Amount Paid : £1976.00 & £233.48 :T
Details :
24/11/06 1st letter sent to Halifax with breakdown of charges. They replied advising charges are part of t&c.
11/12/06 2nd letter sent to Halifax giving seven days for full response before court action. They replied advising the matter would be passed to their Customer Relations Dept. As I considered their letter not to be a full response as requested in my letter I began court action.
28/12/06 entered claim online; dated documents served to Halifax 3/1/07.
Halifax acknowledged claim and had until 31/1/07 to reply/defend.
17/1/07 checked bank account and two credits appear today; one for full charges and another for interest plus costs, just over £2000.00 No letter received yet.
it can be done; don't be scared of the court process. the banks have gotten away with overcharging for too long.
the entire process has taken 55 days; just under 6 weeks.
thanks to Martin :money: and every forum member who offered advice

my stack of statements arrived yesterday all neatly banded together and I worked out the charges to a little over £600 and sent of my first letter.
anyway this morning another envelope arrives containing a few more pages form the statements this had 12 more charges! (a bit suspect that this was seperate)
can i just send another letter asking them to disregard the first or hope the turn down the first and i just update my second letter to include the £900 claim?
thanks in advance and i cant waitthis money will really sort me out
Hi again,
I have put together the leter again with a bit saying please disregard the prevous claim etc etc this new claim is for £900
But i am starting to think i shouldnt send this and that I should just wait for there refusal letter and then respond with letter 2 that would include the extra charges, or if they make an offer based on the first claim i turn it down and claim the new amout?
what would be the best approch here?
Kind Regards

Bigbird, they are clearly dragging their feet. Have you had a written acknowledgement from Customer relations or Halifax Head Office? If so give them a ring. I got a letter from C/Rels - tel 08457 253519. They gave a ref no. to quote if I needed to speak with them. Not sure what you've had but if they mess you about any more it sounds like it's time to move on to court action / Moneyclaim. . keep us all posted on how it goes. Good luck!
Hi skintscouser thanks for advise rang them today and they tried to tell me that they had until the 29th of the month to reply and that they look at all claims in date order. I said that we were working on my timescale and not theirs and they simply replied that they were working on the financial regulations time scale and that they were in there rights to take this long!!! the cocky gits..... andyway told them that i would give them a further week to reply and if not i would proceed to court.
Just noticed tho that i might have cocked up and put three charges in that were prior to the six years should i resend my letter without these charges on.....what a divvy0 -
I am still awaiting my money from Halifax after signing the acceptance form two weeks ago!
However since the beginning of this claim they have still been charging me which has added up to another few hundred pounds the past few months.
I have applied for a new current account with Citibank so if I get accepted for this, can I then claim for the next set of charges Halifax has taken (because if they close my account then as they have stated on the acceptance form it won't matter)!
Any advice0 -
skintscouser wrote:-- I'm not an expert, but have read loads on here... so hope this helps.
Once the notice you have given them is up, file your claim with the court on Moneyclaim on that day. Stick to your timetable. However, it is worth ringing them just before to let them know this is their absolute last chance to settle, and for some people on here that has worked and the bank has settled at the last min - in several cases in full. good luck! and let us all know how it goes.0
