    Entirely up to yourself. Will it be worth it for you. Although I must admit with a lot of people on here, it was our money in the first place.

    I think that as you've filed for court action already then the Halifax will pay it all nearer to the court date. Personally I think it's a fair offer.

    Just for the record I sent my second letter off last Monday and received a reply (plus booklet) within three days. They stated that they were sorry I was dissatisfied with their services and that my claim was being pass onto their complaints department and I should get a reply within 4 weeks. Seems I will be sending letter 3 off next Monday.

    I was advised to claim for the charges and interest from the start (678 charges and 122 in interest), so i have asked for over £800 back.

    As the banks do not have to pay the interest back unless it goes to court could they use this in their defence.
    Eg, I have initially asked for an incorrect amount making the claim invalid therefore getting the case thrown out of court. Sent my first letter off and just want to get things right.

    i did get a reply on 28/12/06 this is what the letter says

    dear sir/madam

    thank you for your recent enquiry regarding charges incurred on your above numberred account.

    I regret to advise you that, having fully considered your request, we are unable to make a refund of the charges applied to your Bank Account.

    I advise that under the Terms and Conditions of the account, Halifax can levy charges when there are insufficient funds in the account to cover items, which are presented for payment. We trust that customers understand these Terms and Conditions when entering into this legally binding contract with us. Unfortunatly, I am unable to refund any charges on this occasion, as there has been no error on the part of the Halifax.

    i sent letter 3 of on 03/01/07 and still no reply. what can i do now?

  • I am currently claiming my bank charges back from the Halifax £3500, they responded to my 1st letter with a 'gesture of goodwill offer' of £1100 which I refused. I have since written to them asking for £2600 in full and final settlement, I advised that I wanted a full response within 7 days. They signed for my letter 9 days ago and as of yet have not responded to my request. Should I allow longer, write again or start court proccedings? can anyone advise, thanks

    I ordered copy bank statements for the past three years from the Halifax on 28th September 2006. The £5 charge was taken on that day.

    So far I have received 2 sets of copies for the past 2 years but still none for the third year. I have made countless calls to them and everytime I am told there was an error, Xmas holidays, records don't go back that far, etc.

    I am fed up now so I am thinking of making an complaint.

    Has anyone had a similar problem? If so, is a formal complaint worthwhile?

    i am not an expert, but you could try ringing them and see if you can negotiate. this has worked for others here. and kick on with court procedings as detailed on this site in the meantime. use the fact they will have to pay interest if u win through Moneyclaim as a bargaining tool if you speak with them to encourage a favourable settlement.

    we dictate the agenda using our rights. not them, good luck mate ;)
    Halifax WON! Claimed £1549 on 8th Jan 2007, Settled for £1350 on 29th Jan, Paid 7th Feb.
    MBNA (Virgin / Alliance Credit Card charges): WON! Claimed £419 on 17 March, finally offered £425! on 5 June)
    Natwest Credit Card: WON! Claimed £250, got 100% + interest + court costs too.
    Northern Rock: Mortgage Discharge Fee: WON! Claimed £100. Offered £90 and accepted it.
    Natwest Bank / RBS: WON! Claimed £400. Got 100% + interest + court fees back.
    Halifax 2: Ongoing....
