Hi, wonder if anyone can help, this may have been asked previously and I've missed it.
I have received the standard "charges are legitimate etc.". I live in Scotland so can only reclaim £750 under the small claims court, the ever so helpful court officer I contacted informed me I would need to appoint a solicitor for more than that. My charges over the last 6 years are for over £2k - has anyone in Scotland got around this ruling without having to employ a solicitor? I'm not giving up but I also don't want to have to pay for a solicitor:rolleyes:0 -
Granma - I'm from Scotland too. Ignore it just now. I asked for £3k+ over the past five years and was told on the phone yesterday by the Halifax that "they'll send out a percentage offer which you can phone up and negotiate a higher amount". It won't get as far as court anyway but if it does then you can adjust your claim to suit if you want to.
The other option is the Financial Ombudsman (no limit to your claim) which the bank needs to give you the option to do if you're not satisfied 8 weeks after they initially received your first letter. If you've had your initial rejection - phone back and ask for a re-assessment of your claim (phone number at the top of the letter). They'll do it no problem. Don't panic.
Keep coming back here with questions and for support. Don't be scared of the process.0 -
sorry but I am new to this site so please bear with me if posts are not up to scratch
Hello all,
I asked for all my previous statements for my halifax and was told it was at a £5 charge for each month. Have phoned a couple of times now and told the same thing. However they did tell me that I have had to pay £1900 in charges since my account was open in 2002. Can I appy for interest on this as well and if so how much? AlsoI have sent two letters and upon reading this thread I am not sure if its a healthy idea to take the matter to court. Please give me some advice0 -

You can do Summary Cause for £1,500 without a solicitor. Its basically the same as small claim but you have to get sheriff officers to serve the summons, the court should have advised this. Otherwise use the FSO it seems to be what a lot of people in scotland are doing. They took my signature away!!!!0 -
Hi can any one give me any advice as to what to put in the particulars of claim section on mcol. I know roughly what to include its just how to word it properly as I dont want to waste £120 fees and have it thrown out!
GOt fed up with waiting for Halifax. My claim was initially rejected on 10th May and I phoned them up for re-evaluating. Since then have phoned twice, 1st time told it would take up to 8 weeks blah blah, then phoned again today to be told 8 weeks was now up to 16th July!! Its getting longer and I am fed up with wiating so have filled in my mcol claim as far as I can but just need advice on wording for the POC bit.
many thanks0 -

Hi, an update on my Halifax claim:
I received the standard 1st rejection letter last week and decided to phone the 0191 number to ask them to reconsider. They said someone would look into it when I phoned on 14th June and to give it a week or two. So, I left it a week and phoned back yesterday and asked for a progress report. The nice girl I spoke to said my re-evaluation was still waiting to be looked at, and she would note my reference number and try to look at it that day or today.
I've just phoned up again today and apparently she did indeed look at it this morning and a letter has been sent out offering me £388 as a goodwill gesture. But I'm claiming for £1028 so will phone them on Monday and ask if there could be any possible movement on this (would be happy with £800 or the full amount). But still, I think that £388 is an admission of guilt and I think I could end up with the full amount :T
So, wish me luck for Monday
Dan0
