Sent first letter for statements on 19th March.
Sent second letter for statements on the 3rd May.
Sent claim for £4,036 and £922 on 19th May
Rejection letter on 29th May
Sent fourth letter threatening court action on the 31st May giving then 2 weeks to reply or court action.
19th June £1,878 in account.
20th June contacted Halifax who gave me two seperate phone numbers to contact regarding two accounts
20th May phone and after some talking and haggling with two nice ladies got £3,756.00 on one account and £922 on second acount.
Hope this helps people who have helped me as without this forum would be lost.

Good luck everyone and stick with a figure your happy with and when negoticating amount your happy with explain the heartache it has cause over a period of time and they will give in
Hi mate , had a letter back saying that they are investigating my case , I just stated that everyone being treated differently and even tho I have been reasonable they have witheld MY money. Will let you know the outcome .regards Degs :TIm not really mad...0 -

Sorry if this is the wrong thread but i just don't seem to be able to navigate this forum very effectively - so please point me in the right direction if not.
I just successfully claimed from halifax - got everything including court fees and interest in my claim but while the claim was going on i got charged an additional £265 in charges. Should i just forget it? I havent accepted their 'goodwill' payment yet but it is in my account.
help!

For anyone struggling to get their statements this might be of interest.
I sent my letter asking that my charges be refunded on 4th June. I didn't have the exact amount I was due but only the past 2 years worth that I calculated from my online statements.
I asked for £1364 to cover the last 2 years and on top of that I requested that THEY review my account and refund ALL charges due covering the past 5 years and to let me know what these charges amounted to.
I got a letter back on the 6th (dated the 5th) which was the standard rejection. I phoned on the 7th June and said I would like my case re-assessed. I pointed out that I'd requested information in my letter which they had NOT provided. I said I felt they hadn't investigated my claim as requested since their was no way they could fully investigate and decide on the very day they received my letter. I also pointed out that they'd ignored my request about charges. I politely requested that they actually LOOK at my claim this time and send me the information I asked for.
The girl told me I'd have my statements within 7 days. I left it a little longer and called on the 19th to aske why I hadn't received them within the 7 day period as promised. The guy apologised and said he'd send them out that night - true to his word I received them on the 20th.
At lunchtime I'm going to call up again and ask them to note on my account that the full amount I'm requesting is £3200 and with interest would amount to £3700. I'm also going to claim I was told my joint account statements would be sent and that they weren't. Hopefully again I'll receive these very quicklyI'll keep you updated.
This might help some people who are having trouble getting statements. It's now 2 weeks and 3 days since I sent my first letter and I've managed to bypass the 40 day waiting period if I'd went down the FOI route for my statements. Worth a try maybe ?
*EDIT* Just called Halifax (the 01977 number). That guy is VERY polite and helpful. He noted the updated amount on my claim and told me "I'll be honest with you. What they'll do is send a letter offering you a percentage and put it straight into your account. You can then call up and tell them you're not happy and negotiate the amount. This used to be quite quick but with the backlog we've got it can take a few weeks just now. You also have the option of going through a court which you'll have to pay an up front fee for but we'd refund that".
Straight from the horses mouth. Oh ... nearly forgot. I also claimed that the guy I talked to the other day was going to send my joint account statements too but he's obviously forgotten because they're sooo busy. Asked if there was any chance I could get them sent out too ? He said they'd be in the post tonight. Another 40 day wait averted. It really does pay to be friendly, polite and a little bit sympathetic to how busy they are0 -

Had ammount in my bank which was half the amount asked for on Tuesday morning, phoned the number given which is a 0151 number and negotiated the full amount but was polite to her at all times. Today the final amount was in my account and the lady stated it would take up to 14 days.
Waiting for other account to be sorted but again offered half the amount but negotiated full amount

First post, but been reading (and learning!) for six months or more. I've been down the suggested claim route, but never got anywhere - well, I got as far as Halifax saying "we've got 8 weeks to reply to you"...and they did. After 8 weeks they sent a letter that basically said "we've looked at your case, and we've decided we're not going to give you any charges back as we're allowed to charge you coz our T's & C's say we can".....
And that's it - I never filed with MCOL (too skint to stump up £120 at the time) and it's all just died a death since then - I think their letter got to me around the middle of May
Soooo....my question is this: Can I pick up where I left off and file with MCOL (total is about £1600 including the interest), or do I need to go back to the beginning/middle and start sending letters again? I feel like a bit of an idiot - if I'd had the cash to file, I would have but instead I just got all disheartened and gave up.......
Can someone (if anyone's ever been this dumb before) give me some advice as to how I can get the ball rolling again..if indeed I can.

Further to my previous post regarding the blagging letter then my call for re-evalution. I have spoken to another very nice man (!) on the 0845 number who basically said that due to volume it has not been looked at yet but that he sent email marked 'urgent' to the re-evaluation team and highlighted the fact that I had waited 8 weeks already. He added that under these circumstances I would move up the queue faster than someone who, say, received their fob off letter shortly after sending the first# complaint. Apparently, this is now standard practice and has been for about two-three weeks - the first letter you send now gets the decline letter sent automatically. However, he said the system works like this - we send you the decline letter, you reject it, we evaluate, you get an offer BUT this can take a couple of weeks as we are so busy at the moment. He also said that I am more then welcome to file claim with court but this would incur me extra costs which I may get refunded but a lot longer down the line. Did offer some advice about contacting the ombudsman and maybe getting my claim dealth with a little quicker that way.
Have decided to give them until the end of next week - if nothing heard will RE-EVALUATE my own situation then!!!!!0 -
Hi Jayney its simple, you carry on with the timescales on this site & if my dates are correct you should start court proceedings (if thats what your willing to do). I bank with Natwest & they ignored my letter asking for my ££ & they ignored the court letter also. I filed my claim with MCOL, they defended it & Im now waiting for a date, be strong & go for it, loads of people are in the same boat!
I spoke to a chap who works @ the Halifax and he said they are starting to wait now until people go to court as many dont do due to the financial aspects, even though the enter a defence they always pay up!jayney0 -

try phoning or emailing the financial ombudsman (link on this site). my friend requested her statements same day as me to halifax (beginning march), i requested official complaint then received them after two months. she still hasn't had hers but has followed the financial ombudsman link and they're chasing them up for her. they told her she would have them within 7 days.jayney0

Hi All
We are currently fighting the halifax for a total of £6701 in bank charges over the past six years, we did all the correct procedures and it ended up in is taking court action through MCOL... they are of course defending the full claim, to which we are very nervous about! Any hints or tips?
They were served the papers on the 4/6/07 and have 28 days to reply to us, to date we have not heard a sausage, only a letter from the courts confirming they are defending the full amount....
We are of course aware that it is too large amount to go through the small claims court... how exactly will this effect us?
