    Yesssss!!!
    I started the process for claiming my charges back from halifax back in Febuary,all the usual fob off letters hubby and I decided toclaim through MCOL.
    The whole idea seemed daunting..
    Checked account this afternoon and sat there was £2654.34 all paid back intrest and court fee.The first time in months we're not overdrawn!!! Thankyou sooo much Martin and everyone who has posted encouragement
    My advice stick with it...... its our money!!!!!

    Congratulations, can i ask when you filed mcol, just to get idea of the timescales. Mine was filed 4th june, served 9th June and nothing has happened since.

    our claim was issued 23rd May
    defendant had till 11thJune to reply
    which they did on 31st May....
    Money in account today 20th June

    and we sent first letter 23rd Feb so about 15weeks from asking for statements to a rightful deposit our account!!

    Just be patient!

    Sent first letter for statements on 19th March.

    Sent second letter for statements on the 3rd May.

    Sent claim for £4,036 and £922 on 19th May

    Rejection letter on 29th May

    Sent fourth letter threatening court action on the 31st May giving then 2 weeks to reply or court action.

    19th June £1,878 in account.

    20th June contacted Halifax who gave me two seperate phone numbers to contact regarding two accounts

    20th May phone and after some talking and haggling with two nice ladies got £3,756.00 on one account and £922 on second acount.

    Hope this helps people who have helped me as without this forum would be lost.

    Ps Degs 45 how hard is to claim interest from FO???

    Good luck everyone and stick with a figure your happy with and when negoticating amount your happy with explain the heartache it has cause over a period of time and they will give in
  • :confused: I finally got my statements after 2 months from Halifax (lodged complaint in meantime) - sent letter asking for full refund of 2,677.39 inc interest, waited 14 days, sent another letter threatening court - 14 days up on Friday 22nd June - Halifax have ignored all my letters! I've kept proof of special delivery. Has anyone else been ignored??? If I carry on being ignored will I win? I don't know what to do - everyone else seems to have had letters!

    Halifax sent me a letter on 15th May saying my complaint was being dealt with and i would hear within 4 weeks - but I haven't told them what I'm complaining about yet! (i'll be complaining about the length of time to get statements, staff on phone assuming i wanted statements for this purpose and about a letter I got from from them saying I had requested that the account be closed - which i hadn't). I still haven't heard about this and it's over 4 weeks.

    The letters saying that they are investigating and will reply sometime between now and the next ice age are little more than acknowledgements of receipt and attempts to make you give up and go away.

    If you threaten to start court proceedings, give them 14 days to reply. If you have not received an acceptable reply by this deadline, then start court proceedings on Money Claim Online.

    Hi Jayney its simple, you carry on with the timescales on this site & if my dates are correct you should start court proceedings (if thats what your willing to do). I bank with Natwest & they ignored my letter asking for my ££ & they ignored the court letter also. I filed my claim with MCOL, they defended it & Im now waiting for a date, be strong & go for it, loads of people are in the same boat!

    I spoke to a chap who works @ the Halifax and he said they are starting to wait now until people go to court as many dont do due to the financial aspects, even though the enter a defence they always pay up! :D
