I am claiming on behalf of my auntie. she has only been with the Halifax for 2 years and is claiming about 2k, we have sent the first letter requesting the money to be refunded. The halifax have wrote back saying something along the lines that you have only been with the bank for years and when you opened the account you signed an agreement stating that the bank have the right to impose charges relating to charges incurred.
Has this happened to anyone else? and what did you do?

    Hello,
Ignore them. This is just another Tactic to stop you claiming the money back, now you have the list of charges i would go straight to mcol and start the claim. It will cost £120 initally but the bank will pay this back to your auntie and she can also claim the 8% interest as well because she's taking it to court, do it sooner rather than later as the process has taken me just over a month now from start to finish, let me know how you get on, Beckie
  • OMG! I'm so happy. Today I checked my Halifax account online and found that they have paid back my bank charges in full. I received £1140.25!

After a tense wait through MCOL they waited until the end of their 28 days and quietly put the money back into my account.

Thank you to everyone on here, I often read how everyone was getting on with their claims. And a big thank you to hunky Martin ;) :T

    Can anyone help?

I owe £1,074 to Halifax on a previously defaulted credit card. They were not charging me any interest for the past two years as it was on an "arrangement" and they never bothered to review it so I have been slowly paying off and have got to the above amount. The problem is I started to reclaim previous charges on the account (from before this arrangement - ie when they and others were stinging me which is why I needed an arrangement!). I've only just put the process in motion so I don't know how much I will be reclaiming, but not a huge amount, maybe £300 at the most. (They have sent me some of the statments but not all as yet).

The problem is, in typical (it seems) Halifax fashion, they suddenly returned my account to a standard one (what a coincidence; just as I started the reclaiming process) and are now charging me 2x 17.95% for "cash" and for "purchases" interest. I don't understand these charges. I'm not sure if they are charging me on the whole amount going back several years, in which case they are being extremely unfair as it was on an arrangement when I got into financial difficulty a few years ago and simply couldn't repay. I am able to pay a bit more than the minimum payments, but not a lot, so it will take me ages to pay it off with these two interest charges. Can they do this? I don't even have a card, the account was in default, so how they can charge me "purchase" interest I don't know!! Of course they have to get their money back somewhere, if I am to reclaim the charges, and it seems I can't do anything about the interest charges which seem excessive especially as I don't even have a card with them as such, just a debt!

I am going to write or call them, but i'm sure it's going to be a nightmare! Any advice on the legality of what they are doing (considering I don't even have a card and am making no purchases!) would be very much appreciated!

    Thanks

You can ring them if you like. Just don't expect a cheque for all your charges by return of post, though.

As you threatened to start court proceedings, gave them 14 days to reply and have not received an acceptable reply by your deadline, then start court proceedings on Money Claim Online.

I am currently at the stage of having filed with MCOL, and the claim being acknowledged, I am waiting for a defence to be filed and continue the court process, Halifax to cough up, or no defence being entered and asking for judgement.

Some people have reported offers for varying amounts much before this time and some after, some have been given telephone numbers to ring and 'negotiate' offers whilst others have not.

It seems odd that such organisations can be so random in dealing with us all.

Is there a master plan with this bank or others ?
