    Hi there, just to let you all know that I have been trying to reclaim charges on behalf om sister in law. I followed all the advice on hear and after threatening Halifax with court and then recieving their standard 'these charges are fair we're not paying you' letter I filed with moneyclaim. The acknowledged the claim and so had 28 days to enter their defence. That time is up tomorrow. Got a very excited call today from my Sister in law to say when she went to withdrawn some money there was the full amount plus interest plus court fee in the account. So to any of you still waiting or thinking about accepting offers I would think twice. They did'nt even attempt to defend the case. She will be ringing them tomorrow to ask if they will be paying the other later claim we have done for her partners account. If not we'll be going through money claim again.
    So on her behalf can I just say thanks very much for all the advice on here.

    hi hope someone can help - finally recieved my statements today after waiting for them since 14th March (and a lot of phones calls etc) and would like to know what is the best address to send my first letter and list of bank charges to? also what kind of timescales from this letter being sent to either getting an offer or going via mcol - wasd reading through posts and looks like halifax have 8 weeks but wanted to check and make sure.

    Hi all,

    Today received the standard letter " sorry but the charges were part of your T & C when you opend the account..... if you are unhappy with decission please contact us within the next 8 weeks" now I called them and explained I was already in the court process after they said it could be reviewed and they said well thers is nothing more we can do now. So where do I go from here just wait till the court bit does its thing?

    try and keep everything in writing (and recorded delivery) as per the process outlined by Martin Lewis on here. That way you have proof of what you have done. Give them timescales to keep to and take them to court if they dont reply or comply in time. If you keep ringing you'll get mixed messages from each person you speak with and it'll drive you mad and may delay your claim. Good luck.

    Phoned Halifax this morning in regards to how long it was to be re-assessed, lady on phone was polite but dispute between dates of first letter sent. It is important that you send all correspondence via recorded delivery as I have had to send proof of delivery which I had so it cuts down the eight weeks that they have to reply as they will have a date which is different to yours :)

    where do you file for MCOL?? I phoned them and they said they are well within their rights to answer my letter within 3 weeks, do I file for MCOL as I put 14 days on my letter. Please let me know what you think thank you!!!

    i have won my case and halifax have awarded me 100%. i have tried phoning but they are now closed so thought id quickly ask here. they say they are going to refund me the amount into the account within 5 working days but i closed that account a year ago, will they automatically send a cheque or will they reopen the account ?

    slightly confused on this claims - ive received my money from halifax all well and good and the letter says if i dont accept it i have 14 days to reply, now they've stiched me up with another 4 charges for one direct debit bouncing and its almost £130 thats gonna leave my account. is it worth claiming this back in the negotiation? ive already used some of the money that they gave me...does that mean i accept their payment?

    I am claiming on behalf of my auntie. she has only been with the Halifax for 2 years and is claiming about 2k, we have sent the first letter requesting the money to be refunded. The halifax have wrote back saying something along the lines that you have only been with the bank for years and when you opened the account you signed an agreement stating that the bank have the right to impose charges relating to charges incurred.
    Has this happened to anyone else? and what did you do?:mad:

    I sent mine back to the head office in Halifax-same address as where they'd sent my statements from.Got the standard blah blah fobbing off letter a few days later, rung them & asked nicely to reconsider the request.The girl was ok about it but said it could take up to 8 weeks....I shall be ringing them again next week! So pleased to read the success stories fingers crossed we all get our money back-Martin deserves a knighthood!Good Luck Everyone!!:T:A

    I would send any letters to your local branch of Halifax, i did even though they denied ever receiving anything from me (send via recorded delivery?)
    Then i got a letter a couple of days later saying these charges are Fair blah blah blah. I think a lot of it is down to luck who you speak to on the phone, some people get their charges back straight away just by haggling, others like me don't and have to go to court, give them a ring and see what they say, don't accept anything less though and just threaten them with court explaining all the extra charges they will pay and that they will have to pay 8% interst if you take them to court, hop this helps, lot's of luck and keep going, Beckie:rotfl: :rotfl: :rotfl: :rotfl: :rotfl:
